A bill to be entitled
2An act relating to specialty license plates; providing a
3short title; amending ss. 320.08056 and 320.08058, F.S.;
4creating a Let's Go Surfing license plate; establishing an
5annual use fee for the plate; providing for the
6distribution of use fees received from the sale of such
7plates; providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  This act may be cited as the "Eric Jersted
12Memorial Act."
13     Section 2.  Paragraph (qqq) is added to subsection (4) of
14section 320.08056, Florida Statutes, to read:
15     320.08056  Specialty license plates.--
16     (4)  The following license plate annual use fees shall be
17collected for the appropriate specialty license plates:
18     (qqq)  Let's Go Surfing license plate, $25.
19     Section 3.  Subsection (69) is added to section 320.08058,
20Florida Statutes, to read:
21     320.08058  Specialty license plates.--
22     (69)  LET'S GO SURFING LICENSE PLATES.--
23     (a)  The department shall develop a Let's Go Surfing
24license plate as provided in this section. Let's Go Surfing
25license plates must bear the colors and design approved by the
26department. The word "Florida" must appear at the top of the
27plate, and the words "Let's Go Surfing" must appear at the
28bottom of the plate.
29     (b)  The license plate annual use fees shall be distributed
30to East Coast Surfing Hall of Fame and Museum, Inc., to fund
31activities, programs, and projects to promote Florida's surfing-
32related tourism, preserve Florida's surfing history and
33heritage, preserve Florida's surf and shores, and honor
34lifeguards who patrol Florida's surf and shores to protect
35beach-goers, surfers, and others. East Coast Surfing Hall of
36Fame and Museum, Inc., may retain all revenue from the annual
37use fees until all startup costs for developing and establishing
38the plate have been recovered. Thereafter, up to 25 percent of
39the annual use fee revenue may be used for administration,
40promotion, and marketing of the plate, including the annual
41audit and compliance affidavit costs.
42     Section 4.  This act shall take effect October 1, 2009.
