3     Amendment (with title amendment)
4     Remove lines 267-275 and insert:
5     Section 2.  Subsections (14) and (15) of section 97.012,
6Florida Statutes, are renumbered as subsections (15) and (16),
7respectively, and new subsections (14) and (17) are added to
8that section to read:
9     97.012  Secretary of State as chief election officer.--The
10Secretary of State is the chief election officer of the state,
11and it is his or her responsibility to:
12     (14)  Provide direction and opinions to the supervisors of
13elections on the performance of their official duties with
14respect to chapters 97-102 and chapter 105 or rules adopted by
15the Department of State.
16     (17)  Be nonpartisan in all decisions and statements. The
17secretary may not:
18     (a)  Hold an office in or take an active role in any
19function of a political organization;
20     (b)  Publicly endorse or publicly oppose a candidate for
21public office or partisan organization;
22     (c)  Take a public position for or against, or participate
23in, a campaign to support or oppose the merits of any ballot
24initiative or ballot measure, except to act in his or her
25official capacity;
26     (d)  Make speeches on behalf of a candidate or political
27organization;
28     (e)  Attend political party functions, except to act in his
29or her official capacity; or
30     (f)  Solicit funds for, pay an assessment to, or make a
31contribution to a political organization or candidate, or
32purchase, accept, or distribute tickets for any political party
33function.

35A person who violates this subsection commits a misdemeanor of
36the second degree, punishable as provided in s. 775.082 or s.
37775.083.
