       Senator Baker moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Section 377.807, Florida Statutes, is created to
    6  read:
    7         377.807Energy-efficient appliance rebate program.—
    8         (1)The Florida Energy and Climate Commission is authorized
    9  to develop and administer a consumer rebate program for
   10  residential energy-efficient appliances, consistent with 42
   11  U.S.C. s. 15821 and any federal agency guidance or regulations
   12  issued in furtherance of federal law.
   13         (2)The commission may adopt rules pursuant to ss.
   14  120.536(1) and 120.54 designating eligible appliances, rebate
   15  amounts, and the administration of the issuance of rebates. The
   16  rules shall be consistent with 42 U.S.C. s. 15821 and any
   17  subsequent implementing federal regulations or guidance.
   18         (3)The commission is authorized to enter into contracts or
   19  memoranda of agreement with other agencies of the state, public
   20  private partnerships, or other arrangements such that the most
   21  efficient means of administering consumer rebates can be
   22  achieved.
   23         Section 2. For the 2009-2010 fiscal year, the sum of
   24  $150,000 is appropriated from the General Revenue Fund to the
   25  Florida Energy and Climate Commission for the purpose of
   26  administering the energy-efficient appliance rebate program;
   27  however, the funds shall not be released to the commission until
   28  it has submitted a report to the Legislative Budget Commission
   29  certifying that the energy-efficient appliance rebate program
   30  complies with 42 U.S.C. s. 15821 and any subsequent implementing
   31  federal regulations and that the state will receive funds
   32  pursuant to 42 U.S.C. s. 15821 and the American Recovery and
   33  Reinvestment Act of 2009 to implement the energy-efficient
   34  appliance rebate program.
   35         Section 3. This act shall take effect July 1, 2009.

   44         the Florida Energy and Climate Commission to develop
   45         and administer a consumer rebate program for specified
   46         energy-efficient appliances; authorizing the
   47         commission to adopt rules; authorizing the commission
   48         to enter into contracts or memoranda of agreement with
   49         other agencies of the state, public-private
   50         partnerships, and other arrangements for specified
   51         purposes; providing an appropriation; providing
   52         requirements for the release of the appropriation;
   53         providing an effective date.
