    1                        A bill to be entitled                      
    2         An act relating to the energy-efficient appliance
    3         rebate program; creating s. 377.807, F.S.; authorizing
    4         the Florida Energy and Climate Commission to develop
    5         and administer the program; authorizing the commission
    6         to adopt rules; providing for the commission to enter
    7         into contracts or memoranda of agreement with other
    8         state agencies or partnerships; providing an effective
    9         date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Section 377.807, Florida Statutes, is created to
   14  read:
   15         377.807Energy-efficient appliance rebate program.—The
   16  Florida Energy and Climate Commission is authorized to develop
   17  and administer a consumer rebate program for residential energy
   18  efficient appliances, consistent with 42 U.S.C. s. 15821 and any
   19  federal agency guidance or regulations issued in furtherance of
   20  federal law. Such appliances may include Energy Star products or
   21  electric tankless water heaters that have an energy-efficiency
   22  rating of at least 85 percent by the United States Environmental
   23  Protection Agency standard calculation, if not otherwise
   24  disqualified by the United States Environmental Protection
   25  Agency or the United States Department of Energy, as validated
   26  by a third-party testing entity, and verified by the commission,
   27  pursuant to rule. The commission may adopt rules pursuant to
   28  ss.120.536(1) and 120.54 concerning program provisions deemed by
   29  federal law to be within the discretion of the commission,
   30  consistent with 42 U.S.C. s. 15821 and any subsequent
   31  implementing federal regulations or guidance. The commission is
   32  authorized to enter into contracts or memoranda of agreement
   33  with other agencies of the state, public-private partnerships,
   34  or other arrangements such that the most efficient means of
   35  administering consumer rebates can be achieved.
   36         Section 2. This act shall take effect July 1, 2009.
