2An act relating to the Lake Asbury Municipal Service
3Benefit District, Clay County; amending chapter 86-392,
4Laws of Florida; authorizing the board of district
5trustees to increase the cap on special assessments
6against lots in the district, subject to voter approval at
7a referendum; providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Paragraph (j) of subsection (4) of section 2 of
12chapter 86-392, Laws of Florida, is amended to read:
13     Section 2.  The following is the charter of the Lake Asbury
14Municipal Service Benefit District:
15     (4)  The district is authorized and empowered:
16     (j)  To assess for each year of its operation against every
17lot in the district a special assessment not to exceed $100,
18provided that an assessment greater than $100 per lot may be
19established by the Board of District Trustees upon approval by
20majority vote of the electors of the district voting in a
21referendum called for that purpose.
22     1.  The assessment above shall be billed and collected as
23provided by Florida law, the rules of the Florida Department of
24Revenue, and appropriate county ordinances, as applicable. The
25procedures of s. 197.0126, Florida Statutes, shall be utilized
26in collection and assessment upon written agreement with the
27County Property Appraiser providing for reimbursement of
28administrative costs incurred. All actions and procedures for
29collections by the Property Appraiser or the Tax Collector shall
30be as described by general Florida law.
31     2.  The special assessments shall be payable at the time
32and in the manner set forth as prescribed in chapter 197,
33Florida Statutes, or as may be subsequently modified by the
34governing body, and shall be and remain liens on the assessed
35property, coequal with the lien of all state, county, district,
36and municipal taxes, and superior in dignity to all other liens,
37titles, and claims, until paid and shall bear interest at a rate
38not to exceed 18 percent per annum.
39     Section 2.  This act shall take effect upon becoming a law.
