    1                        A bill to be entitled                      
    2         An act relating to traffic offenses; creating s.
    3         318.195, F.S.; providing penalties for the commission
    4         of a noncriminal traffic infraction or certain other
    5         violations that cause or result in the serious injury
    6         of a motorcyclist, bicyclist, pedestrian, or person of
    7         other means of conveyance; providing enhanced
    8         penalties for such violations that cause the death of
    9         such person; providing that the act does not prohibit
   10         the person from being charged with, convicted of, or
   11         punished for any other violation of law; providing an
   12         effective date.

   14  Be It Enacted by the Legislature of the State of Florida:
   15  
   16         Section 1. Section 318.195, Florida Statutes, is created to
   17  read:
   18         318.195Enhanced penalties for moving violations causing
   19  injury or death.—
   20         (1) A person whose commission of a noncriminal traffic
   21  infraction or any violation of this chapter causes or results in
   22  the serious injury of a motorcyclist, bicyclist, pedestrian, or
   23  person of other means of conveyance shall serve 30 days house
   24  arrest, be fined $500, and have his or her license suspended for
   25  30 days. If the infraction or violation causes the death of a
   26  motorcyclist, bicyclist, pedestrian, or person of other means of
   27  conveyance, the person shall serve a minimum of 90 days in jail,
   28  pay a fine of $1,000, and have his or her license suspended for
   29  a minimum of 1 year.
   30         (2) This section does not prohibit a person from being
   31  charged with, convicted of, or punished for any other violation
   32  of law.
   33         Section 2. This act shall take effect July 1, 2010.
