    1                        A bill to be entitled                      
    2         An act relating to trust funds; creating s. 948.511,
    3         F.S.; creating the Community Corrections Trust Fund
    4         within the Department of Corrections; specifying the
    5         purpose of the trust fund; providing a funding source
    6         for the trust fund; providing for the future review
    7         and termination or re-creation of the trust fund;
    8         providing a contingent effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Section 948.511, Florida Statutes, is created to
   13  read:
   14         948.511Community Corrections Trust Fund.—
   15         (1)The Community Corrections Trust Fund is created within
   16  the Department of Corrections. The trust fund shall be
   17  administered by the secretary or his or her designee. Funds
   18  allocated to the trust fund include funds received from the
   19  Federal Government in support of community correction
   20  activities. The funds shall be used to support the activities of
   21  the community corrections program to counties or county
   22  consortiums as provided in s. 948.51.
   23         (2)Notwithstanding s. 216.301 and pursuant to s. 216.351,
   24  any balance in the trust fund at the end of any fiscal year
   25  shall remain in the trust fund and be available for carrying out
   26  the purposes of the trust fund.
   27         (3)In accordance with s. 19(f)(2), Art. III of the State
   28  Constitution, the Community Corrections Trust Fund shall, unless
   29  terminated sooner, be terminated on July 1, 2014. Before its
   30  scheduled termination, the trust fund shall be reviewed as
   31  provided in s. 215.3206(1) and (2).
   32         Section 2. This act shall take effect on the same date that
   33  Senate Bill ___ or similar legislation takes effect, if such
   34  legislation is adopted in the same legislative session, or an
   35  extension thereof, and becomes law, but this act shall not take
   36  effect unless it is enacted by a three-fifths vote of the
   37  membership of each house of the Legislature.
