       The Committee on Judiciary (Bogdanoff) recommended the
       following:
       
    1         Senate Amendment 
    2  
    3         Delete line 46
    4  and insert:
    5  administrator. In lieu of using an independent administrator, a
    6  photo lineup eyewitness identification procedure may be
    7  conducted using an alternative method specified and approved by
    8  the Criminal Justice Standards and Training Commission. Any
    9  alternative method must be carefully structured to achieve
   10  neutral administration and to prevent the administrator from
   11  knowing which photograph is being presented to the eyewitness
   12  during the identification procedure. Alternative methods may
   13  include any of the following:
   14         1.Automated computer programs that can automatically
   15  administer the photo lineup directly to an eyewitness and
   16  prevent the lineup administrator from seeing which photo the
   17  witness is viewing until after the procedure is completed.
   18         2.A procedure in which photographs are placed in folders,
   19  randomly numbered, and shuffled and then presented to an
   20  eyewitness such that the administrator cannot see or track which
   21  photograph is being presented to the witness until after the
   22  procedure is completed.
   23         3.Any other procedure that achieves neutral administration
   24  and prevents the administrator from knowing which photograph is
   25  being presented to the eyewitness during the identification
   26  procedure.
