    1                        A bill to be entitled                      
    2         An act relating to educational services in Department
    3         of Juvenile Justice programs; amending s. 1003.52,
    4         F.S.; providing that adult education general education
    5         development test preparation courses and adult
    6         education career education courses may be offered as
    7         electives to high school level students who have a
    8         transition plan that does not include a return to
    9         public high school; providing an effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Paragraph (a) of subsection (3) of section
   14  1003.52, Florida Statutes, is amended to read:
   15         1003.52 Educational services in Department of Juvenile
   16  Justice programs.—
   17         (3) The district school board of the county in which the
   18  residential or nonresidential care facility or juvenile
   19  assessment facility is located shall provide appropriate
   20  educational assessments and an appropriate program of
   21  instruction and special education services.
   22         (a) The district school board shall make provisions for
   23  each student to participate in basic, career education, and
   24  exceptional student programs as appropriate. Students served in
   25  Department of Juvenile Justice programs shall have access to the
   26  appropriate courses and instruction to prepare them for the GED
   27  test. Students participating in GED preparation programs shall
   28  be funded at the basic program cost factor for Department of
   29  Juvenile Justice programs in the Florida Education Finance
   30  Program. Adult education GED test preparation courses and adult
   31  education career education courses may be offered as electives
   32  to high school level students who have a transition plan that
   33  does not include a return to public high school. Each program
   34  shall be conducted according to applicable law providing for the
   35  operation of public schools and rules of the State Board of
   36  Education. School districts shall provide the GED exit option
   37  for all juvenile justice programs.
   38         Section 2. This act shall take effect July 1, 2011.
