       Senator Latvala moved the following:
       
    1         Senate Amendment to Amendment (302038) (with title
    2  amendment)
    3  
    4         Delete lines 174 - 328
    5  and insert:
    6         Section 6. Subsection (3) of section 316.075, Florida
    7  Statutes, is amended to read:
    8         316.075 Traffic control signal devices.—
    9         (3)(a) No traffic control signal device shall be used which
   10  does not exhibit a yellow or “caution” light between the green
   11  or “go” signal and the red or “stop” signal.
   12         (b) No traffic control signal device shall display other
   13  than the color red at the top of the vertical signal, nor shall
   14  it display other than the color red at the extreme left of the
   15  horizontal signal.
   16         (c) The Department of Transportation shall establish
   17  minimum yellow light change interval times for traffic control
   18  devices. The minimum yellow light change interval time shall be
   19  established in accordance with nationally recognized engineering
   20  standards set forth in the Institute of Transportation Engineers
   21  Traffic Engineering Handbook, and any such established time may
   22  not be less than the recognized national standard.
   23         Section 7. Present subsections (3) and (4) of section
   24  316.0083, Florida Statutes, are renumbered as subsections (4)
   25  and (5), respectively, and a new subsection (3) is added to that
   26  section, to read:
   27         316.0083 Mark Wandall Traffic Safety Program;
   28  administration; report.—
   29         (3) An affirmation indicating compliance with s. 316.075(3)
   30  must accompany the notice of violation and a traffic citation.
   31  Such affirmation is admissible in any proceeding to enforce this
   32  section and raises a rebuttable presumption that the traffic
   33  control signal device meets the requirements of s. 316.075(3).
