6 | Be It Enacted by the Legislature of the State of Florida: |

8 | Section 1. Paragraph (a) of subsection (4) of section |
9 | 448.110, Florida Statutes, is amended to read: |
10 | 448.110 State minimum wage; annual wage adjustment; |
11 | enforcement.- |
12 | (4)(a) Beginning September 30, 2005, and annually on |
13 | September 30 thereafter, the Agency for Workforce Innovation |
14 | shall calculate an adjusted state minimum wage rate by |
15 | increasing the state minimum wage by the rate of inflation for |
16 | the 12 months prior to September 1. In calculating the adjusted |
17 | state minimum wage, the agency shall use the Consumer Price |
18 | Index for Urban Wage Earners and Clerical Workers, not |
19 | seasonally adjusted, for the South Region or a successor index |
20 | as calculated by the United States Department of Labor. To |
21 | determine the adjusted state minimum wage rate, the agency shall |
22 | first calculate the difference between the Consumer Price Index |
23 | from August of the previous year and from August of the current |
24 | year and apply that difference to the previous year's wage rate |
25 | calculation. The adjusted state minimum wage rate takes effect |
26 | as the Florida minimum wage, as defined in s. 448.109(1)(b), |
27 | when both the previous year's Florida minimum wage and the |
28 | federal minimum wage are lower than the adjusted state minimum |
29 | wage rate. Each adjusted state minimum wage rate shall take |
30 | effect on the following January 1, with the initial adjusted |
31 | minimum wage rate to take effect on January 1, 2006. |
32 | Section 2. This act shall take effect July 1, 2011. |
