       The Committee on Communications, Energy, and Public Utilities
       (Smith) recommended the following:

    6         (7)(4) In order to assure that consumers have access to
    7  different local exchange service providers without being
    8  disadvantaged, deterred, or inconvenienced by having to give up
    9  the consumer’s existing local telephone number, all providers of
   10  local exchange services must have access to local telephone
   11  numbering resources and assignments on equitable terms that
   12  include a recognition of the scarcity of such resources and are
   13  in accordance with national assignment guidelines. Each local
   14  exchange provider, except small local exchange
   15  telecommunications companies under rate of return regulation,
   16  shall provide a temporary means of achieving telephone number
   17  portability. The parties, under the direction of the commission,
   18  shall set up a number portability standards group by no later
   19  than September 1, 1995, for the purposes of investigation and
   20  development of appropriate parameters, costs, and standards for
   21  number portability. If the parties are unable to successfully
   22  negotiate the prices, terms, and conditions of a temporary
   23  number portability solution, the commission shall establish a
   24  temporary number portability solution by no later than January
   25  1, 1996. Each local exchange service provider shall make
   26  necessary modifications to allow permanent portability of local
   27  telephone numbers between certificated providers of local
   28  exchange service as soon as reasonably possible after the
   29  development of national standards. The parties shall negotiate
   30  the prices, terms, and conditions for permanent telephone number
   31  portability arrangements. In the event the parties are unable to
   32  satisfactorily negotiate the prices, terms, and conditions,
   33  either party may petition the commission and the commission
   34  shall, after opportunity for a hearing, set the rates, terms,
   35  and conditions. The prices and rates shall not be below cost.
   36  Number portability between different certificated providers of
   37  local exchange service at the same location shall be provided
   38  temporarily no later than January 1, 1996.
