    1                        A bill to be entitled                      
    2         An act relating to the state minimum wage; amending s.
    3         448.109, F.S.; conforming a provision to changes made
    4         by the act; amending s. 448.110, F.S.; providing for
    5         calculating the Florida minimum wage when the state
    6         minimum wage and the federal minimum wage for the
    7         prior year is lower than the adjusted real wage;
    8         providing an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Paragraph (b) of subsection (1) of section
   13  448.109, Florida Statutes, is amended to read:
   14         448.109 Notification of the state minimum wage.—
   15         (1) As used in this section, the terms:
   16         (b) “Florida minimum wage” means the wage that an employer
   17  must, at a minimum, pay an employee pursuant to s. 24, Art. X of
   18  the State Constitution and implementing law, including s.
   19  448.110(4)(a).
   20         Section 2. Paragraph (a) of subsection (4) of section
   21  448.110, Florida Statutes, is amended to read:
   22         448.110 State minimum wage; annual wage adjustment;
   23  enforcement.—
   24         (4)(a) Beginning September 30, 2005, and annually on
   25  September 30 thereafter, the Agency for Workforce Innovation
   26  shall calculate an adjusted state minimum wage rate by
   27  increasing the state minimum wage by the rate of inflation for
   28  the 12 months preceding prior to September 1. In calculating the
   29  adjusted state minimum wage, the agency shall use the Consumer
   30  Price Index (CPI) for Urban Wage Earners and Clerical Workers,
   31  not seasonally adjusted, for the South Region or a successor
   32  index as calculated by the United States Department of Labor.
   33  The agency shall calculate the difference between the CPI from
   34  August of the prior year to August of the current year and add
   35  that difference to the previous year’s wage rate calculation to
   36  create the adjusted real wage. The Florida minimum wage, as
   37  defined in s. 448.109(1)(b), is the adjusted real wage if both
   38  the prior year’s state minimum wage and the federal minimum wage
   39  are lower than the adjusted real wage. Each adjusted state
   40  minimum wage rate takes shall take effect on the following
   41  January 1, with the initial adjusted minimum wage rate to take
   42  effect on January 1, 2006.
   43         Section 3. This act shall take effect July 1, 2011.
