    1                        A bill to be entitled                      
    2         An act relating to the John M. McKay Scholarships for
    3         Students with Disabilities Program; amending s.
    4         1002.39, F.S.; providing that when a student who is
    5         receiving the John M. McKay Scholarship enrolls in a
    6         public school or public school program, the term of
    7         the student’s scholarship ends; providing an exception
    8         for students who enter a Department of Juvenile
    9         Justice detention center for a period of no more than
   10         21 days; providing an effective date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Paragraph (a) of subsection (4) of section
   15  1002.39, Florida Statutes, is amended to read:
   16         1002.39 The John M. McKay Scholarships for Students with
   17  Disabilities Program.—There is established a program that is
   18  separate and distinct from the Opportunity Scholarship Program
   19  and is named the John M. McKay Scholarships for Students with
   20  Disabilities Program.
   21         (4) TERM OF JOHN M. MCKAY SCHOLARSHIP.—
   22         (a) For purposes of continuity of educational choice, a
   23  John M. McKay Scholarship shall remain in force until the
   24  student returns to a public school, graduates from high school,
   25  or reaches the age of 22, whichever occurs first. A scholarship
   26  student who enrolls in a public school or public school program
   27  is returning to a public school for the purpose of determining
   28  the end of the scholarship’s term. However, if a student enters
   29  a Department of Juvenile Justice detention center for a period
   30  of no more than 21 days, the student is not considered to be
   31  returning to a public school for that purpose.
   32         Section 2. This act shall take effect July 1, 2011.
