    1                        A bill to be entitled                      
    2         An act relating to trust funds; creating the
    3         Destination Resort Trust Fund within the Department of
    4         Revenue; providing for the purpose of the trust fund;
    5         providing for future review and termination or re
    6         creation of the trust fund; providing a contingent
    7         effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Destination Resort Trust Fund.—
   12         (1) The Destination Resort Trust Fund is created within the
   13  Department of Revenue.
   14         (2) The trust fund is established for the deposit of
   15  licensing fees of destination resorts and the proceeds of gross
   16  receipts taxes imposed on destination resorts. Funds may be
   17  expended only pursuant to legislative appropriation or an
   18  approved amendment to the Destination Resort Commission’s
   19  operating budget pursuant to chapter 216, Florida Statutes.
   20         (3) In accordance with s. 19(f)(2), Article III of the
   21  State Constitution, the Destination Resort Trust Fund shall,
   22  unless terminated sooner, be terminated on July 1, 2015. Before
   23  its scheduled termination, the trust fund shall be reviewed as
   24  provided in s. 215.3206(1) and (2), Florida Statutes.
   25         Section 2. This act shall take effect on the same date that
   26  SB ____ or similar legislation takes effect, if such legislation
   27  is enacted in the same legislative session, or an extension
   28  thereof, and becomes law, and only if this act is enacted by a
   29  three-fifths vote of the membership of each house of the
   30  Legislature.
