       The Committee on Budget (Thrasher) recommended the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 167 - 178
    4  and insert:
    5  
    6         (5) Absent a written agreement between the third-party
    7  provider and the governmental body, the remuneration made
    8  pursuant to subsection (4) must be paid by the governmental body
    9  at a rate not to exceed the following:
   10         (a)For emergency services and care, unrelated to an
   11  admission, provided by a hospital licensed under chapter 395, 75
   12  percent of the hospital’s billed charges;
   13         (b)For hospital inpatient services, other than emergency
   14  services and care, 110 percent of the Medicare Part A
   15  prospective payment applicable to the specific hospital
   16  providing the inpatient services;
   17         (c)For hospital outpatient services, other than emergency
   18  services and care, 110 percent of the Medicare Part A Ambulatory
   19  Payment Classification for the specific hospital providing the
   20  outpatient services; and
   21         (d)For hospitals reporting a negative operating margin for
   22  the previous year to the Agency for Health Care Administration
   23  through hospital-audited financial data, the payments in
   24  paragraphs (b) and (c) shall be 125 percent of the applicable
   25  Medicare prospective payment.
