10Be It Enacted by the Legislature of the State of Florida:
11
12     Section 1.  Paragraph (i) is added to subsection (1) of
13section 893.13, Florida Statutes, to read:
14     893.13  Prohibited acts; penalties.-
15     (1)
16     (i)  Except as authorized by this chapter, it is unlawful
17for any person to sell, manufacture, or deliver, or possess with
18intent to sell, manufacture, or deliver, a controlled substance
19in, on, or within 1,000 feet of the real property comprising a
20homeless shelter. As used in this paragraph, the term "homeless
21shelter" means a supervised publicly or privately operated
22shelter designed to provide temporary living accommodations for
23persons who otherwise lack a fixed, regular, and adequate
24nighttime residence. Any person who violates this paragraph with
25respect to:
26     1.  A controlled substance named or described in s.
27893.03(1)(a), (1)(b), (1)(d), (2)(a), (2)(b), or (2)(c)4.
28commits a felony of the first degree, punishable as provided in
29s. 775.082, s. 775.083, or s. 775.084.
30     2.  A controlled substance named or described in s.
31893.03(1)(c), (2)(c)1., (2)(c)2., (2)(c)3., (2)(c)5., (2)(c)6.,
32(2)(c)7., (2)(c)8., (2)(c)9., (3), or (4) commits a felony of
33the second degree, punishable as provided in s. 775.082, s.
34775.083, or s. 775.084.
35     Section 2.  Paragraphs (c) and (e) of subsection (3) of
36section 921.0022, Florida Statutes, are amended to read:
