Florida Senate - 2012 SB 118 By Senator Lynn 7-00080-12 2012118__ 1 A bill to be entitled 2 An act relating to an environmental surcharge on 3 bottled water; establishing a surcharge on bottled 4 water sold at retail in this state; providing an 5 exception; requiring that moneys collected from the 6 surcharge be deposited into the Ecosystem Management 7 and Restoration Trust Fund; providing an effective 8 date. 9 10 Be It Enacted by the Legislature of the State of Florida: 11 12 Section 1. (1) An environmental surcharge is imposed on 13 each bottle of water sold in the amount of 6 percent of the sale 14 price of each item, article, or group of items of or containing 15 bottled water when sold at retail in this state. The surcharge 16 does not apply to water bottled in a 1-gallon container or 17 larger. 18 (2) All moneys collected from the surcharge levied under 19 this section shall be deposited into the Ecosystem Management 20 and Restoration Trust Fund within the Department of 21 Environmental Protection. 22 (3) The surcharge levied under this section shall be 23 administered, collected, and enforced in the same manner as the 24 tax imposed under s. 212.05, Florida Statutes. 25 Section 2. This act shall take effect October 1, 2012.
