2An act relating to offenses against unborn children;
3providing a short title; amending s. 782.071, F.S.,
4relating to vehicular homicide; defining the term
5"unborn child" for specified purposes; revising
6terminology to refer to "unborn child" rather than
7"viable fetus"; providing legislative intent; amending
8s. 782.09, F.S.; revising terminology; providing that
9certain offenses relating to the killing of an unborn
10child by injury to the mother do not require specified
11knowledge or intent or death of the mother; amending
12ss. 316.193, 435.04, and 921.0022, F.S.; conforming
13terminology; providing an effective date.

15Be It Enacted by the Legislature of the State of Florida:
16
17     Section 1.  This act may be cited as the "Florida Unborn
18Victims of Violence Act."
19     Section 2.  Section 782.071, Florida Statutes, is amended
20to read:
21     782.071  Vehicular homicide.-"Vehicular homicide" is the
22killing of a human being, or the killing of an unborn child a
23viable fetus by any injury to the mother, caused by the
24operation of a motor vehicle by another in a reckless manner
25likely to cause the death of, or great bodily harm to, another.
26     (1)  Vehicular homicide is:
27     (a)  A felony of the second degree, punishable as provided
28in s. 775.082, s. 775.083, or s. 775.084.
29     (b)  A felony of the first degree, punishable as provided
30in s. 775.082, s. 775.083, or s. 775.084, if:
31     1.  At the time of the accident, the person knew, or should
32have known, that the accident occurred; and
33     2.  The person failed to give information and render aid as
34required by s. 316.062.

36This paragraph does not require that the person knew that the
37accident resulted in injury or death.
38     (2)  For purposes of this section, the term "unborn child"
39means the unborn offspring of a human being at any stage of
40gestation from fertilization until birth a fetus is viable when
41it becomes capable of meaningful life outside the womb through
42standard medical measures.
43     (3)  A right of action for civil damages shall exist under
44s. 768.19, under all circumstances, for all deaths described in
45this section. However, this section does not create or expand
46any civil cause of action for negligence based on statute or
47common law.
48     (4)  In addition to any other punishment, the court may
49order the person to serve 120 community service hours in a
50trauma center or hospital that regularly receives victims of
51vehicle accidents, under the supervision of a registered nurse,
52an emergency room physician, or an emergency medical technician
53pursuant to a voluntary community service program operated by
54the trauma center or hospital.
55     Section 3.  Section 782.09, Florida Statutes, is amended to
56read:
57     782.09  Killing of unborn quick child by injury to mother.-
58     (1)  The unlawful killing of an unborn quick child, by any
59injury to the mother of such child which would be murder if it
60resulted in the death of such mother, shall be deemed murder in
61the same degree as that which would have been committed against
62the mother. Any person, other than the mother, who unlawfully
63kills an unborn quick child by any injury to the mother:
64     (a)  Which would be murder in the first degree constituting
65a capital felony if it resulted in the mother's death commits
66murder in the first degree constituting a capital felony,
67punishable as provided in s. 775.082.
68     (b)  Which would be murder in the second degree if it
69resulted in the mother's death commits murder in the second
70degree, a felony of the first degree, punishable as provided in
71s. 775.082, s. 775.083, or s. 775.084.
72     (c)  Which would be murder in the third degree if it
73resulted in the mother's death commits murder in the third
74degree, a felony of the second degree, punishable as provided in
75s. 775.082, s. 775.083, or s. 775.084.
76     (2)  The unlawful killing of an unborn quick child by any
77injury to the mother of such child which would be manslaughter
78if it resulted in the death of such mother is shall be deemed
79manslaughter. A person who unlawfully kills an unborn quick
80child by any injury to the mother which would be manslaughter if
81it resulted in the mother's death commits manslaughter, a felony
82of the second degree, punishable as provided in s. 775.082, s.
83775.083, or s. 775.084.
84     (3)  The death of the mother resulting from the same act or
85criminal episode that caused the death of the unborn quick child
86does not bar prosecution under this section.
87     (4)  This section does not authorize the prosecution of any
88person in connection with a termination of pregnancy pursuant to
89chapter 390.
90     (5)  For purposes of this section, the definition of the
91term "unborn quick child" shall be determined in accordance with
92the definition of an unborn child viable fetus as set forth in
93s. 782.071.
94     (6)  An offense under this section does not require:
95     (a)  That the person engaging in the conduct:
96     1.  Had knowledge or should have had knowledge that the
97mother was pregnant; or
98     2.  Intended to cause the death of, or bodily injury to,
99the unborn child.
100     (b)  The death of the mother.
101     Section 4.  Subsection (3) of section 316.193, Florida
102Statutes, is amended to read:
103     316.193  Driving under the influence; penalties.-
104     (3)  Any person:
105     (a)  Who is in violation of subsection (1);
106     (b)  Who operates a vehicle; and
107     (c)  Who, by reason of such operation, causes or
108contributes to causing:
109     1.  Damage to the property or person of another commits a
110misdemeanor of the first degree, punishable as provided in s.
111775.082 or s. 775.083.
112     2.  Serious bodily injury to another, as defined in s.
113316.1933, commits a felony of the third degree, punishable as
114provided in s. 775.082, s. 775.083, or s. 775.084.
115     3.  The death of any human being or unborn quick child
116commits DUI manslaughter, and commits:
117     a.  A felony of the second degree, punishable as provided
118in s. 775.082, s. 775.083, or s. 775.084.
119     b.  A felony of the first degree, punishable as provided in
120s. 775.082, s. 775.083, or s. 775.084, if:
121     (I)  At the time of the crash, the person knew, or should
122have known, that the crash occurred; and
123     (II)  The person failed to give information and render aid
124as required by s. 316.062.

126For purposes of this subsection, the definition of the term
127"unborn quick child" shall be determined in accordance with the
128definition of an unborn child viable fetus as set forth in s.
129782.071. A person who is convicted of DUI manslaughter shall be
130sentenced to a mandatory minimum term of imprisonment of 4
131years.
132     Section 5.  Paragraph (g) of subsection (2) of section
133435.04, Florida Statutes, is amended to read:
134     435.04  Level 2 screening standards.-
135     (2)  The security background investigations under this
136section must ensure that no persons subject to the provisions of
137this section have been arrested for and are awaiting final
138disposition of, have been found guilty of, regardless of
139adjudication, or entered a plea of nolo contendere or guilty to,
140or have been adjudicated delinquent and the record has not been
141sealed or expunged for, any offense prohibited under any of the
142following provisions of state law or similar law of another
143jurisdiction:
144     (g)  Section 782.09, relating to killing of an unborn quick
145child by injury to the mother.
146     Section 6.  Paragraph (g) of subsection (3) of section
147921.0022, Florida Statutes, is amended to read:
