Florida Senate - 2012 SB 1148 By Senator Lynn 7-01178-12 20121148__ 1 A bill to be entitled 2 An act relating to workplace safety; creating s. 3 284.51, F.S.; providing definitions; requiring all 4 public employers to comply with certain federal 5 Occupational Safety and Health Administration 6 standards by a certain date; requiring the Department 7 of Financial Services to annually report injury and 8 illness data for public employers to the Governor, the 9 President of the Senate, and the Speaker of the House 10 of Representatives and publish such data on the 11 department’s website; requiring the department to 12 provide certain information on its website by a 13 certain date; providing an effective date. 14 15 Be It Enacted by the Legislature of the State of Florida: 16 17 Section 1. Section 284.51, Florida Statutes, is created to 18 read: 19 284.51 Public employer workplace safety.— 20 (1) As used in this section, the term: 21 (a) “Department” means the Department of Financial 22 Services. 23 (b) “OSHA” means the Occupational Safety and Health 24 Administration in the United States Department of Labor. 25 (c) “Public employer” means any agency within state, 26 county, or municipal government, including any school district, 27 which employs individuals for salary, wages, or other 28 remuneration. 29 (2) Effective June 30, 2015, all public employers must 30 comply with OSHA general industry standards, 29 C.F.R. part 31 1910, and OSHA construction standards, 29 C.F.R. part 1926, as 32 applicable. 33 (3) The department shall annually report to the Governor, 34 the President of the Senate, and the Speaker of the House of 35 Representatives the injury and illness data for public employers 36 in the aggregate as well as on a per-public-employer basis. Such 37 data shall be published on the department’s website. 38 (4) Effective October 1, 2012, the department shall 39 establish and publicize on its website, for public employers and 40 employees to access, information related to workplace safety. 41 Section 2. This act shall take effect July 1, 2012.
