       Senator Fasano moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. The Office of Program Policy Analysis and
    6  Government Accountability shall conduct a review of the state’s
    7  system of developing rates for workers’ compensation insurance
    8  for the specific purpose of analyzing the use of rating
    9  organizations in the ratemaking process authorized under chapter
   10  627, Florida Statutes.
   11         (1) The review must include an analysis of, and
   12  recommendations relating to:
   13         (a) The process of selecting rating organizations and
   14  whether multiple rating organizations exist;
   15         (b) The criteria used for selecting rating organizations,
   16  including the transactional relationships of rating
   17  organizations with the insurance industry;
   18         (c) The data-collection methodology, including how
   19  information is collected from insurance carriers and self
   20  insured employers and how that data is used by the rating
   21  organizations;
   22         (d) The process for independently reviewing a rating
   23  organization’s information, reports, and filings, including a
   24  specific recommendation on whether the independent actuarial
   25  peer review conducted biannually is an effective means for
   26  evaluating the performance of a state rating organization;
   27         (e) Other states systems for submitting and approving
   28  workers compensation rates by carriers and self-insured
   29  employers; and
   30         (f) Any other related matters that the office deems
   31  appropriate for legislative review.
   32         (2) The office shall complete and submit the review to the
   33  Legislature by March 1, 2013.
   34         Section 2. This act shall take effect upon becoming a law.

   38         Delete everything before the enacting clause
   39  and insert:
   40                        A bill to be entitled                      
   41         An act relating to workers’ compensation insurance
   42         rates; requiring the Office of Program Policy Analysis
   43         and Government Accountability to conduct a review of
   44         workers’ compensation rating organizations and submit
   45         such review to the Legislature by a certain date;
   46         providing an effective date.
