CS/HB 1329: Health Care Consumer Protection

GENERAL BILL by Health and Human Services Quality Subcommittee ; Corcoran

Health Care Consumer Protection; Revises Florida Patient's Bill of Rights & Responsibilities to require certain health care practitioners to publish & distribute schedule of charges for services provided to patients; specifies text display requirements; exempts primary care providers who voluntarily published & maintained schedule of charges within specified dates; defines terms "diagnostic-imaging center" & "urgent care center"; requires that urgent care centers, ambulatory surgical centers, & diagnostic-imaging centers publish & post schedule of charges for services provided to patients; specifies text display requirements; requires schedule to be in language comprehensible to layperson; specifies posted size & allows for electronic posting; provides exception; provides for fines; adds failure to comply with provisions of s. 381.026, F.S., to grounds for discipline of health care practitioner; prohibits provider of emergency medical care & services from billing patient; prohibits certain providers of nonemergency medical care & services from billing patient directly; requires insurers to inform insured of certain providers who may bill insured for medical services; requires hospitals to disclose to certain patients which of its contracted providers will treat patients & which of those may bill patients directly; provides exception; requires hospitals to provide contact information for those providers to patient; requires certain providers in hospital to inform certain patients in writing whether they will be billed directly; requires certain providers in hospital to provide to patient estimate of amount to be billed directly by provider; prohibits certain providers from directly billing patient if actual charges are 200 percent or more greater than estimate provided to patient; releases patient from liability if provider fails to disclose billing information; provides exception.
