    1                        A bill to be entitled                      
    2         An act relating to the state employees’ prescription
    3         drug program; amending s. 110.12315, F.S.; requiring
    4         the Department of Management Services to authorize
    5         certain pharmacies to dispense 90-day maintenance
    6         prescription medication to certain patients;
    7         specifying a dispensing fee for a 90-day prescription
    8         supply; providing an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Subsections (3) through (7) of section
   13  110.12315, Florida Statutes, are renumbered as subsections (4)
   14  through (8), respectively, and a new subsection (3) is added to
   15  that section to read:
   16         110.12315 Prescription drug program.—The state employees’
   17  prescription drug program is established. This program shall be
   18  administered by the Department of Management Services, according
   19  to the terms and conditions of the plan as established by the
   20  relevant provisions of the annual General Appropriations Act and
   21  implementing legislation, subject to the following conditions:
   22         (3) The Department of Management Services shall authorize
   23  any retail pharmacy licensed in this state and participating in
   24  the program to dispense a 90-day maintenance prescription
   25  medication to a program member, subscriber, or covered dependent
   26  with a chronic disease, including, but not limited to, heart
   27  disease, diabetes, HIV/AIDS, end-stage renal disease, or cancer.
   28  The dispensing fee for a 90-day supply shall be 1.5 times the
   29  amount paid for a 30-day supply.
   30         Section 2. This act shall take effect July 1, 2012.
