Florida Senate - 2012 SB 1688 By Senator Wise 5-01405-12 20121688__ 1 A bill to be entitled 2 An act relating to claim bills; amending s. 11.065, 3 F.S.; requiring that the Department of Law Enforcement 4 expunge the criminal history record of a claimant 5 pertaining to the claim following passage of a claim 6 bill if the bill specifies that such action is 7 warranted; providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Section 11.065, Florida Statutes, is amended to 12 read: 13 11.065 Claims against state; limitations; notice; 14 expungement of records.— 15 (1) A claimNo claimsagainst the state may notshallbe 16 presented to the Legislature more than 4 years after the cause 17 for relief accrued. AAnyclaim presented after this time of 18 limitation isshall bevoid and unenforceable. 19 (2) All relief acts of the Legislature shall be for payment 20 in full.NoFurther claims for relief may notshallbe submitted 21 to the Legislature in the future. 22 (3) Notice shall be given as provided in s. 11.02 before 23prior tothe introduction of any relief act thatwhichprovides 24 for the payment of the claim from funds scheduled for 25 distribution to a municipality from the revenue-sharing trust 26 fund for municipalities. 27 (4) Notwithstanding any other law, upon final passage of a 28 legislative claim bill specifying that such action is warranted, 29 the Department of Law Enforcement shall expunge the criminal 30 history record of the claimant which directly pertains to the 31 claim. 32 Section 2. This act shall take effect July 1, 2012.
