       Senator Latvala moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 1234 and 1235
    4  insert:
    5         (g) An insured seeking benefits under ss. 627.730627.7405,
    6  including omnibus insureds, must comply with the terms of the
    7  policy, which include, but are not limited to, submitting to an
    8  examination under oath. The scope of questioning during the
    9  examination under oath is limited to relevant information or
   10  information that could reasonably be expected to lead to
   11  relevant information. Compliance with this paragraph is a
   12  condition precedent to receiving benefits. An insurer that, as a
   13  general practice as determined by the office, requests an
   14  examination under oath of an insured or an omnibus insured
   15  without a reasonable basis is subject to s. 626.9541.

   20  insert:
   21         providing that an insured must comply with the terms
   22         of the policy, including submitting to examinations
   23         under oath;
