       Senator Lynn moved the following:
       
    1         Senate Amendment (with title amendment)

    3         Between lines 504 and 505
    4  insert:
    5         Section 9. Paragraph (e) is added to subsection (2) of
    6  section 395.0191, Florida Statutes, to read:
    7         395.0191 Staff membership and clinical privileges.—
    8         (2)
    9         (e) Each licensed facility shall establish policies and
   10  procedures for the employment of surgical technologists.
   11         1.For purposes of this paragraph, “surgical technologist”
   12  means a person who assists and practices under the supervision
   13  of a surgeon to ensure that the operating room environment is
   14  safe, that proper equipment is available, and that the operative
   15  procedure is conducted efficiently, provided that nothing in
   16  this subparagraph alters or affects any other law related to the
   17  supervision of surgical technologists. Surgical technologist
   18  duties include, but are not limited to, maintaining sterility
   19  during a surgical procedure, handling and ensuring the
   20  availability of necessary equipment and supplies, and
   21  maintaining visibility of the operative site.
   22         2. The licensed facility may consider for such employment
   23  only a person who:
   24         a. Has successfully completed a surgical technologist
   25  training program accredited by the Accrediting Bureau of Health
   26  Education Schools or the Commission on Accreditation of Allied
   27  Health Education Programs; and
   28         b. Holds certification as a surgical technologist from an
   29  organization recognized by the National Commission for
   30  Certifying Agencies. Such certification must be maintained
   31  throughout employment at the facility,
   32  
   33  unless the licensed facility continuously employs a person who
   34  is working as a surgical technologist on October 1, 2012, or
   35  uses a licensed practitioner subject to chapter 456 or a student
   36  as a surgical technologist, and such practitioner or student is
   37  appropriately trained and performs duties only within his or her
   38  scope of practice.

   43  and insert:
   44         inspection; amending s. 395.0191, F.S.; requiring
   45         licensed facilities to establish policies and
   46         procedures for the employment of surgical
   47         technologists; providing a definition; providing
   48         educational and credentialing requirements; providing
   49         exceptions; amending s. 395.0193, F.S.; requiring a
