Floor: WD/2R . 04/29/2013 05:09 PM . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Braynon moved the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 634 - 678 4 and insert: 5 (a) Constructing, reconstructing, renovating, modernizing, 6 or improving a facility and, for newly constructed facilities, 7 land acquisition; or reimbursing such costs. 8 (b) Paying or pledging for the payment of debt service on, 9 or to fund debt service reserve funds, arbitrage rebate 10 obligations, or other amounts payable with respect thereto, 11 bonds issued for the construction, reconstruction, 12 modernization, improvement, or renovation of such facility and, 13 for newly constructed facilities, land acquisition; or for the 14 reimbursement of such costs or the refinancing of bonds issued 15 for such purposes. 16 (9) REPORTS.— 17 (a) On or before November 1 of each year, an applicant 18 certified under this section and approved to receive state funds 19 must submit to the department any information required by the 20 department. The department shall summarize this information for 21 inclusion in the report to the Legislature due February 1 under 22 paragraph (4)(d). 23 (b) Every 5 years following the first month that an 24 applicant receives a monthly distribution, the department must 25 verify that the applicant is meeting the program requirements. 26 If the applicant is not meeting program requirements, the 27 department must notify the Governor and the Legislature of the 28 requirements not being met and must recommend future action as 29 part of the report to the Legislature due February 1 under 30 paragraph (4)(d). The department shall consider exceptions that 31 may have prevented the applicant from meeting the program 32 requirements. Such exceptions include: 33 1. Force majeure events. 34 2. Significant economic downturn. 35 3. Other extenuating circumstances. 36 (10) AUDITS.—The Auditor General may conduct audits 37 pursuant to s. 11.45 to verify the independent analysis required 38 under paragraphs (6)(b) and (7)(c) and to verify that the 39 distributions are expended as required. The Auditor General 40 shall report the findings to the department. If the Auditor 41 General determines that the distribution payments are not 42 expended as required, the Auditor General must notify the 43 Department of Revenue, which may pursue recovery of 44 distributions under the laws and rules that govern the 45 assessment of taxes. 46 (11) APPLICATION RELATED TO SIGNATURE EVENT.—If an 47 applicant intends to apply, before the 2014 Regular Session, for 48 a signature event for which state funds for a project are 49 requested, the applicant may apply for the program after May 1, 50 2013. The department must review the application and recommend 51 approval or denial of the application to the Legislature. The 52 Legislative Budget Commission may approve such applications and 53 distributions of funds.
