    2         An act relating to specialty license plates; amending
    3         s. 320.08056, F.S.; revising the annual use fee for
    4         the Florida Wildflower license plate; amending s.
    5         320.08058, F.S.; revising provisions for distribution
    6         and use of fees collected from the sale of certain
    7         specialty license plates; providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Paragraph (aa) of subsection (4) of section
   12  320.08056, Florida Statutes, is amended to read:
   13         320.08056 Specialty license plates.—
   14         (4) The following license plate annual use fees shall be
   15  collected for the appropriate specialty license plates:
   16         (aa) Florida Wildflower license plate, $25 $15.
   17         Section 2. Paragraph (b) of subsection (4) and subsection
   18  (27) of section 320.08058, Florida Statutes, is amended to read:
   19         320.08058 Specialty license plates.—
   20         (4) FLORIDA SALUTES VETERANS LICENSE PLATES.—
   21         (b) The Florida Salutes Veterans license plate annual use
   22  fee shall be distributed as follows:
   23         1. Twenty Ten percent shall be distributed to a direct
   24  support organization created under s. 292.055 for a period not
   25  to exceed 48 months after the date the direct-support
   26  organization is incorporated.
   27         2. Any remaining fees must be deposited in the State Homes
   28  for Veterans Trust Fund, which is created in the State Treasury.
   29  All such moneys are to be administered by the Department of
   30  Veterans’ Affairs and must be used solely for the purpose of
   31  constructing, operating, and maintaining domiciliary and nursing
   32  homes for veterans and for continuing promotion and marketing of
   33  the license plate, subject to the requirements of chapter 216.
   34         (27) FLORIDA WILDFLOWER LICENSE PLATES.—
   35         (a) The department shall develop a Florida Wildflower
   36  license plate as provided in this section. The word “Florida”
   37  must appear at the top of the plate, and the words “State
   38  Wildflower” and “coreopsis” must appear at the bottom of the
   39  plate.
   40         (b) The annual use fees shall be distributed to the Florida
   41  Wildflower Foundation, Inc., a nonprofit corporation under s.
   42  501(c)(3) of the Internal Revenue Code. The proceeds must be
   43  used to establish native Florida wildflower research programs,
   44  wildflower educational programs, and wildflower grant programs
   45  to municipal, county, and community-based groups in this state.
   46         1. The Florida Wildflower Foundation, Inc., shall develop
   47  procedures of operation, research contracts, education and
   48  marketing programs, and wildflower planting grants for Florida
   49  native wildflowers, plants, and grasses.
   50         2. A maximum of 20 15 percent of the proceeds from the sale
   51  of such plates may be used for administrative and marketing
   52  costs.
   53         3. If the Florida Wildflower Foundation, Inc., ceases to be
   54  an active nonprofit corporation under s. 501(c)(3) of the
   55  Internal Revenue Code, the proceeds from the annual use fee
   56  shall be deposited into the General Inspection Trust Fund
   57  created within the Department of Agriculture and Consumer
   58  Services. Any funds held by the Florida Wildflower Foundation,
   59  Inc., must be promptly transferred to the General Inspection
   60  Trust Fund. The Department of Agriculture and Consumer Services
   61  shall use and administer the proceeds from the use fee in the
   62  manner specified in this paragraph.
   63         Section 3. This act shall take effect October 1, 2013.
