5 Section 6. Subsection (1) and paragraph (a) of subsection
6 (3) of section 1008.34, Florida Statutes, are amended to read:
7 1008.34 School grading system; school report cards;
8 district grade.—
9 (1) ANNUAL REPORTS.—The Commissioner of Education shall
10 prepare annual reports of the results of the statewide
11 assessment program which describe student achievement in the
12 state, each district, and each school. The commissioner shall
13 prescribe the design and content of these reports, which must
14 include descriptions of the performance of all schools
15 participating in the assessment program and all of their major
16 student populations as determined by the commissioner. The
17 report must also include the percent of students performing at
18 or above grade level and making a year’s learning gains growth
19 in a year’s time in reading and mathematics. The provisions of
20 s. 1002.22 pertaining to student records apply to this section.
21 (3) DESIGNATION OF SCHOOL GRADES.—
22 (a) Beginning with the 2013-2014 school year, each school
23 that has students who are tested and included in the school
24 grading system shall receive a school grade if the number of its
25 students tested on statewide assessments pursuant to s. 1008.22
26 meets or exceeds the minimum sample size of 10, except as
27 follows:
28 1. A school shall not receive a school grade if the number
29 of its students tested and included in the school grading system
30 is less than the minimum sample size necessary, based on
31 accepted professional practice, for statistical reliability and
32 prevention of the unlawful release of personally identifiable
33 student data under s. 1002.22 or 20 U.S.C. s. 1232g.
34 1.2. An alternative school may choose to receive a school
35 grade under this section or a school improvement rating under s.
36 1008.341. For charter schools that meet the definition of an
37 alternative school pursuant to State Board of Education rule,
38 the decision to receive a school grade is the decision of the
39 charter school governing board.
40 2.3. A school that serves any combination of students in
41 kindergarten through grade 3 which does not receive a school
42 grade because its students are not tested and included in the
43 school grading system shall receive the school grade designation
44 of a K-3 feeder pattern school identified by the Department of
45 Education and verified by the school district. A school feeder
46 pattern exists if at least 60 percent of the students in the
47 school serving a combination of students in kindergarten through
48 grade 3 are scheduled to be assigned to the graded school.
49 3. If a colocated school does not earn a school grade or
50 school improvement rating for the performance of its students,
51 the student performance data of all schools operating at the
52 same facility must be aggregated to develop a school grade that
53 will be assigned to all schools at that location. A colocated
54 school is a school that has its own unique master school
55 identification number, provides for the education of each of its
56 enrolled students, and operates at the same facility as another
57 school that has its own unique master school identification
58 number and provides for the education of each of its enrolled
59 students.
