    1                        A bill to be entitled                      
    2         An act relating to the sale of liquid fuels; amending
    3         s. 526.141, F.S.; requiring self-service stations to
    4         display on each pump a decal containing a telephone
    5         number to enable certain handicapped persons to seek
    6         assistance from the station attendant; requiring the
    7         Department of Agriculture and Consumer Services to
    8         provide decals and instructions; providing for
    9         enforcement by the department; providing for the
   10         adoption of rules; establishing a deadline for
   11         compliance; providing an effective date.

   13  Be It Enacted by the Legislature of the State of Florida:
   14  
   15         Section 1. Subsection (3) of section 526.141, Florida
   16  Statutes, is amended to read:
   17         526.141 Self-service gasoline stations; attendants;
   18  regulations.—
   19         (3) All self-service gasoline stations must shall have at
   20  least one attendant on duty while the station is open to the
   21  public. The attendant on duty shall be mentally and physically
   22  capable of performing the functions and assuming the
   23  responsibilities prescribed in this subsection.
   24         (a) The attendant’s primary function shall be the proper
   25  administration, supervision, observation, and control of the
   26  dispensing of flammable and combustible liquids used as motor
   27  fuels while such liquids are actually being dispensed. It shall
   28  be the responsibility of The attendant shall to prevent the
   29  dispensing of flammable and combustible liquids used as motor
   30  fuels into portable containers unless such container bears a
   31  seal of approval of a nationally recognized testing agency; to
   32  control sources of ignition; and immediately to handle
   33  accidental spills and fire extinguishers if needed. The
   34  attendant on duty shall be mentally and physically capable of
   35  performing the functions and assuming the responsibility
   36  prescribed in this subsection.
   37         (b) Such stations shall also display on each pump a decal
   38  bearing a telephone number to call the attendant to enable the
   39  operator of a motor vehicle that displays an exemption parking
   40  permit as provided in s. 316.1958 or s. 320.0848 or a license
   41  plate issued pursuant to s. 320.084, s. 320.0842, s. 320.0843,
   42  or s. 320.0845 to request service or assistance. The decal must
   43  be prominently displayed on the front of each self-service pump
   44  and near the inspection decal and must contain a blank space
   45  upon which the telephone number can be written. The Department
   46  of Agriculture and Consumer Services, when inspecting a station,
   47  shall apply the decals to the pumps and provide instructions to
   48  the operator for displaying the decals and complying with this
   49  paragraph. The department shall enforce this subsection and
   50  shall adopt rules to administer this subsection. All self
   51  service gasoline stations must comply with this paragraph by
   52  July 1, 2015.
   53         Section 2. This act shall take effect July 1, 2013.
