Section 429.241, Florida Statutes, is created 6 to read: 7 429.241 Facilities licensed for flexible beds.— 8 (1) Beginning January 1, 2014, a facility may apply for a 9 flexible beds license. 10 (2) A facility licensed for flexible beds must: 11 (a) Retain a log listing the names of residents who have 12 contracted for and are receiving assisted living services in 13 flexible beds living units, the unit number in which such 14 residents reside, the date the contract for such services 15 commenced, the date that services ended in the flexible bed 16 living unit if applicable, and documentation to demonstrate that 17 minimum staffing standards are met; 18 (b) Specify in the flexible bed contract the process that 19 will be used to determine when a resident is no longer eligible 20 for services provided through the flexible bed license. Such 21 contract for services must also outline if the delivery of 22 services in a flexible beds living unit will be covered under 23 the existing residency agreement or will require a fee for 24 service payment; and 25 (c) Retain flexible bed contracts for five years after such 26 services end. All other records must be retained for at least 27 two years from the date of termination of assisted living 28 services. 29 (3) Upon request, a facility licensed for flexible beds 30 shall provide state surveyors with access to the log described 31 in paragraph (2)(a).State surveyors shall also have access to 32 independent living units occupied by residents who are receiving 33 services through the flexible bed license at the time of any 34 survey. Additionally, state surveyors may interview residents 35 who have received services through the flexible beds license 36 since the last biennial survey, but who are no longer receiving 37 such services. 38 (4) A flexible bed license does not preclude a resident who 39 lives in a building that has such a license from obtaining home 40 health services in accordance with the policies of the facility. 41 42 ================= T I T L E A M E N D M E N T ================ 43 And the title is amended as follows: 44 Delete line 266 45 and insert: 46 determine penalties and fines; creating s. 429.241, 47 F.S.; providing that a facility may apply for a 48 flexible beds license; requiring a facility licensed 49 for flexible beds to keep a log, specify certain 50 information in a flexible beds contract, and retain 51 certain records; requiring a licensed flexible beds 52 facility to provide state surveyors with access to the 53 log and certain independent living units; providing 54 that state surveyors may interview certain residents; 55 specifying limitations; amending s. 429.26,
