House Comm: RCS . 04/02/2013 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Health Policy (Flores) recommended the following: 1 Senate Amendment (with directory and title amendments) 2 3 Between lines 111 and 112 4 insert: 5 (7) A home health agency shall submit to the agency, within 6 15 days after the end of each calendar quarter, a written report 7 that includes the following data as they existed on the last day 8 of the quarter: 9 (a) The number of insulin-dependent diabetic patients who 10 receive insulin-injection services from the home health agency. 11 (b) The number of patients who receive both home health 12 services from the home health agency and hospice services. 13 (c) The number of patients who receive home health services 14 from the home health agency. 15 (d) The name and license number of each nurse whose primary 16 job responsibility is to provide home health services to 17 patients and who received remuneration from the home health 18 agency in excess of $25,000 during the calendar quarter. 19 20 If the home health agency fails to submit the written quarterly 21 report within 15 days after the end of each calendar quarter, 22 the Agency for Health Care Administration shall impose a fine 23 against the home health agency in the amount of $200 per day 24 until the Agency for Health Care Administration receives the 25 report, except that the total fine imposed pursuant to this 26 subsection may not exceed $5,000 per quarter. A home health 27 agency is exempt from the imposition of the fine if it is not a 28 Medicaid or Medicare provider or if it does not share a 29 controlling interest with an entity licensed, registered, or 30 certified under part II of chapter 408 which bills the Florida 31 Medicaid program or the Medicare program. 32 33 ====== D I R E C T O R Y C L A U S E A M E N D M E N T ====== 34 And the directory clause is amended as follows: 35 Delete lines 10 - 11 36 and insert: 37 Section 1. Present subsection (7) of section 400.474, 38 Florida Statutes, is renumbered as subsection (8), a new 39 subsection (7) is added to that section, and subsection (6) of 40 that section is amended, to read: 41 42 ================= T I T L E A M E N D M E N T ================ 43 And the title is amended as follows: 44 Delete lines 3 - 6 45 and insert: 46 400.474, F.S.; revising the requirements for the 47 quarterly reporting by a home health agency of certain 48 data submitted to the Agency for Health Care 49 Administration; imposing a fine for failure to timely 50 submit the quarterly report; providing an exemption to 51 the imposition of the fine; providing an effective 52 date.
