Florida Senate - 2013 CS for SB 1122 By the Committee on Community Affairs; and Senators Simpson and Dean 578-03429-13 20131122c1 1 A bill to be entitled 2 An act relating to the Florida Fire Prevention Code; 3 amending s. 633.0215, F.S.; providing that certain 4 authorities in rural areas or small communities may 5 decrease fire flow requirements; providing that fire 6 officials shall enforce Florida Building Code 7 provisions for occupancy separation for certain 8 structures with certain occupancies; exempting certain 9 farming and ranching structures from the code; 10 providing an effective date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Subsection (16) is added to section 633.0215, 15 Florida Statutes, to read: 16 633.0215 Florida Fire Prevention Code.— 17 (16)(a) Fire flow requirements may be decreased by the 18 authority that has jurisdiction for isolated buildings or a 19 group of buildings in rural areas or small communities, as 20 defined in the Florida Fire Prevention Code, if that authority 21 determines that the development of full fire flow requirements 22 is impractical. 23 (b) For one-story or two-story structures that are less 24 than 10,000 square feet, whose occupancy is defined in the 25 Florida Building Code and the Florida Fire Prevention Code as 26 business or mercantile, a fire official shall enforce the wall 27 fire-rating provisions for occupancy separation as defined in 28 the Florida Building Code. 29 (c) A farming or ranching structure, as part of an 30 operation that employs fewer than 25 full-time equivalent 31 workers, calculated as cumulative hours worked divided by 40 32 hours, which is not used by the public for direct sales or as an 33 educational outreach facility, is exempt from the Florida Fire 34 Prevention Code, including the national codes and Life Safety 35 Code incorporated by reference. This paragraph does not include 36 structures used for residential or assembly occupancies, as 37 defined in the Florida Fire Prevention Code. 38 Section 2. This act shall take effect July 1, 2013.
