CS/CS/HB 1319: Assisted Living Facilities

GENERAL BILL by Health Care Appropriations Subcommittee ; Health Innovation Subcommittee ; Gonzalez

Assisted Living Facilities; Provides that Medicaid prepaid behavioral health plans are responsible for enrolled mental health residents; provides that managing entities under contract with DCF are responsible for mental health residents who are not enrolled with Medicaid prepaid behavioral health plan; requires that, upon admission to long-term care facility, resident or representative of resident be informed of resident rights; provides that initial extended congregate care licenses are provisional; revises frequency of & conditions for monitoring visits to certain facilities; authorizes agency to deny or revoke facility's extended congregate care license; requires an ALF to obtain limited mental health license under certain circumstances; revises criteria upon which agency must deny or revoke license of an assisted living facility; deletes requirement that agency to provide list of facilities with denied, suspended, or revoked licenses to DBPR; requires agency to establish database for collection of certain information; provides sanctions for failure to comply with reporting requirements; requires development of electronic systems of communication among all agencies involved in regulation of ALFs; requires agency to submit report to Governor & Legislature; requires agency to propose rating system of ALFs for consumers; provides appropriations. APPROPRIATION: $359,388
