       Senator Clemens moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 489 and 490
    4  insert:
    5         Section 14. Section 626.9959, Florida Statutes, is created
    6  to read:
    7         626.9959Navigator entities.—
    8         (1) As used in this part, the term “navigator entity” means
    9  a corporation that is exempt from taxation under s. 501(c) of
   10  the Internal Revenue Code and that is contracted or
   11  subcontracted with a health insurance exchange to perform
   12  activities pursuant to 42 U.S.C. s. 18031(i)(1).
   13         (2) The application for registration described under s.
   14  626.9952(2) must allow the applicant the option of identifying a
   15  navigator entity on behalf of which the applicant intends to
   16  perform the activities of a navigator.
   17         (3) An individual who performs the activities of a
   18  navigator under the sanction of and exclusively on behalf of a
   19  navigator entity:
   20         (a) Is exempt from the requirements of s. 626.9953(3)(g),
   21  (4), (5), and (6); and
   22         (b) Is not subject to the revocation of registration as a
   23  navigator or to a penalty or fine for violation of s. 626.9956
   24  for a first offense.
   25         (4) Before determining the nature and severity of any
   26  penalties or fines levied pursuant to s. 626.9956, the
   27  department shall:
   28         (a) Notify the navigator entity named on the individual’s
   29  application for registration in writing of the specific nature
   30  of the infraction or offense;
   31         (b) Suspend such determination for 30 days after providing
   32  such notification, unless a written response is received from
   33  the navigator entity during the 30-day period; and
   34         (c) Consider any information provided by the navigator
   35  entity pertaining to the navigator and the infraction, which may
   36  include, but is not limited to, information concerning internal
   37  punishment levied, corrective action required by the exchange,
   38  and any mitigating circumstances.
