Senator Richter moved the following:

5 insert:
6 Section 61. Subsection (1) and paragraphs (a) and (b) of
7 subsection (2) of section 627.744, Florida Statutes, are amended
8 to read:
9 627.744 Required preinsurance inspection of private
10 passenger motor vehicles.—
11 (1) A private passenger motor vehicle insurance policy
12 providing physical damage coverage, including collision or
13 comprehensive coverage, may not be issued in this state unless
14 the insurer has inspected the motor vehicle in accordance with
15 this section. The physical damage coverage on the motor vehicle
16 may not be suspended during the term of the policy due to the
17 applicant’s failure to provide the required documents. However,
18 payment of a claim may be conditioned upon the receipt by the
19 insurer of the required documents, and no physical damage loss
20 occurring after the effective date of the coverage is payable
21 until the documents are provided to the insurer.
22 (2) This section does not apply:
23 (a) To a policy for a policyholder who has been insured for
24 2 years or longer, without interruption, under a private
25 passenger motor vehicle policy which provides physical damage
26 coverage on any vehicle, if the agent of the insurer verifies
27 the previous coverage.
28 (b) To a new, unused motor vehicle purchased or leased from
29 a licensed motor vehicle dealer or leasing company, if the
30 insurer is provided with:
31 1. A bill of sale or buyer’s order or lease agreement which
32 contains a full description of the motor vehicle, including all
33 options and accessories; or
34 2. A copy of the title or registration which establishes
35 transfer of ownership from the dealer or leasing company to the
36 customer and a copy of the window sticker or the dealer invoice
37 showing the itemized options and equipment and the total retail
38 price of the vehicle.

40 For the purposes of this paragraph, the physical damage coverage
41 on the motor vehicle may not be suspended during the term of the
42 policy due to the applicant’s failure to provide the required
43 documents. However, payment of a claim is conditioned upon the
44 receipt by the insurer of the required documents, and no
45 physical damage loss occurring after the effective date of the
46 coverage is payable until the documents are provided to the
47 insurer.
