       Senator Garcia moved the following:
       
    1         Senate Amendment to Amendment (740626) (with title
    2  amendment)
    3  
    4         Between lines 993 and 994
    5  insert:
    6         Section 21. Section 338.166, Florida Statutes, is amended
    7  to read:
    8         338.166 High-occupancy toll lanes or express lanes.—
    9         (1) Under s. 11, Art. VII of the State Constitution, the
   10  department may request the Division of Bond Finance to issue
   11  bonds secured by toll revenues collected on high-occupancy toll
   12  lanes or express lanes established on facilities owned by the
   13  department.
   14         (2) The department may continue to collect the toll on the
   15  high-occupancy toll lanes or express lanes after the discharge
   16  of any bond indebtedness related to such project. All tolls so
   17  collected shall first be used to pay the annual cost of the
   18  operation, maintenance, and improvement of the high-occupancy
   19  toll lanes or express lanes project within the county where the
   20  tolls were generated or associated transportation system.
   21         (3) Any remaining toll revenue from the high-occupancy toll
   22  lanes or express lanes shall be used by the department for the
   23  construction, maintenance, or improvement of any road on the
   24  State Highway System within the county or counties in which the
   25  toll revenues were collected or to support express bus service
   26  on the facility where the toll revenues were collected.
   27         (4) The department may implement variable rate tolls on
   28  high-occupancy toll lanes or express lanes.
   29         (5) Except for high-occupancy toll lanes or express lanes,
   30  tolls may not be charged for use of an interstate highway where
   31  tolls were not charged as of July 1, 1997.
   32         (6) This section does not apply to the turnpike system as
   33  defined under the Florida Turnpike Enterprise Law.

   38  insert:
   39         amending s. 338.166, F.S.; requiring that toll revenue
   40         from high-occupancy toll lanes or express lanes first
   41         be used for certain costs within the county in which
   42         the tolls were collected;
