1 A bill to be entitled
2 An act relating to specialty license plates; amending
3 s. 320.08056, F.S.; authorizing the collection of
4 annual use fees for the Fallen Law Enforcement
5 Officers license plate and the Florida Sheriffs
6 Association license plate; amending s. 320.08058,
7 F.S.; revising provisions relating to the distribution
8 of annual use funds to the Astronauts Memorial
9 Foundation, Inc., for the Challenger/Columbia
10 specialty license plate; requiring the St. Johns River
11 Alliance, Inc., and National Hispanic Corporate
12 Achievers, Inc., to each record a certain number of
13 sales within a certain timeframe; requiring the
14 Department of Highway Safety and Motor Vehicles to
15 discontinue the plates under certain circumstances;
16 providing for repeal on a specified date; creating a
17 Fallen Law Enforcement Officers license plate and a
18 Florida Sheriffs Association license plate;
19 establishing an annual use fee for the plates;
20 providing for the distribution of use fees received
21 from the sale of such plates; providing effective
22 dates.

24 Be It Enacted by the Legislature of the State of Florida:
25
26 Section 1. Paragraphs (eeee) and (ffff) are added to
27 subsection (4) of section 320.08056, Florida Statutes, to read:
28 320.08056 Specialty license plates.—
29 (4) The following license plate annual use fees shall be
30 collected for the appropriate specialty license plates:
31 (eeee) Fallen Law Enforcement Officers license plate, $25.
32 (ffff) Florida Sheriffs Association license plate, $25.
33 Section 2. Paragraph (b) of subsection (2) and paragraph
34 (b) of subsection (70) of section 320.08058, Florida Statutes,
35 are amended, paragraph (d) is added to subsection (71), and
36 subsections (83) and (84) are added to that section, to read:
37 320.08058 Specialty license plates.—
38 (2) CHALLENGER/COLUMBIA LICENSE PLATES.—
39 (b) The Challenger/Columbia license plate annual use fee
40 must be distributed to the Astronauts Memorial Foundation, Inc.,
41 to support the operations of the Center for Space Education and
42 the Space Mirror Memorial located at the Kennedy Space Center
43 Education Technology Institute. Funds received by the Astronauts
44 Memorial Foundation, Inc., may be used for administrative costs
45 directly associated with the operation of the center and the
46 memorial institute. These funds must be used for the maintenance
47 and support of the operations of the Center for Space Education
48 and the Space Mirror Memorial Education Technology Institute
49 operated by the Astronauts Memorial Foundation, Inc. These
50 operations must include programs and infrastructure that inform,
51 inspire, and educate the public on the benefits of human space
52 flight preservice and inservice training in the use of
53 technology for the state’s instructional personnel in a manner
54 consistent with state training programs and approved by the
55 Department of Education. Up to 20 percent of funds received by
56 the Astronauts Memorial Foundation, Inc., Center for Space
57 Education and the Education Technology Institute may be expended
58 for administrative costs directly associated with the operation
59 of the center and the institute.
60 (70) ST. JOHNS RIVER LICENSE PLATES.—
61 (b) The requirements of s. 320.08053 must be met prior to
62 the issuance of the plate. Thereafter, the license plate annual
63 use fees shall be distributed to the St. Johns River Alliance,
64 Inc., a s. 501(c)(3) nonprofit organization, which shall
65 administer the fees as follows:
66 1. The St. Johns River Alliance, Inc., shall retain the
67 first $60,000 of the annual use fees as direct reimbursement for
68 administrative costs, startup costs, and costs incurred in the
69 development and approval process. Thereafter, up to 10 percent
70 of the annual use fee revenue may be used for administrative
71 costs directly associated with education programs, conservation,
72 research, and grant administration of the organization, and up
73 to 10 percent may be used for promotion and marketing of the
74 specialty license plate.
75 2. At least 30 percent of the fees shall be available for
76 competitive grants for targeted community-based or county-based
77 research or projects for which state funding is limited or not
78 currently available. The remaining 50 percent shall be directed
79 toward community outreach and access programs. The competitive
80 grants shall be administered and approved by the board of
81 directors of the St. Johns River Alliance, Inc. A grant advisory
82 committee shall be composed of six members chosen by the St.
83 Johns River Alliance board members.
84 3. Any remaining funds shall be distributed with the
85 approval of and accountability to the board of directors of the
86 St. Johns River Alliance, Inc., and shall be used to support
87 activities contributing to education, outreach, and springs
88 conservation.
89 4. Effective July 1, 2014, the St. Johns River license
90 plate will shift into the presale voucher phase, as provided in
91 s. 320.08053(3)(b). The St. Johns River Alliance, Inc., shall
92 have 24 months to record a minimum of 1,000 sales of the license
93 plates. Sales include existing active plates and vouchers sold
94 subsequent to July 1, 2014. During the voucher period, new
95 plates may not be issued, but existing plates may be renewed.
96 If, at the conclusion of the 24-month presale period, the
97 requirement of a minimum of 1,000 sales has been met, the
98 department shall resume normal distribution of the St. Johns
99 River specialty plate. If, after 24 months, the minimum of 1,000
100 sales has not been met, the department shall discontinue the
101 development and issuance of the plate. This subparagraph is
102 repealed June 30, 2016.
103 (71) HISPANIC ACHIEVERS LICENSE PLATES.—
104 (d) Effective July 1, 2014, the Hispanic Achievers license
105 plate will shift into the presale voucher phase, as provided in
106 s. 320.08053(3)(b). National Hispanic Corporate Achievers, Inc.,
107 shall have 24 months to record a minimum of 1,000 sales. Sales
108 include existing active plates and vouchers sold subsequent to
109 July 1, 2014. During the voucher period, new plates may not be
110 issued, but existing plates may be renewed. If, at the
111 conclusion of the 24-month presale period, the requirement of a
112 minimum of 1,000 sales has been met, the department shall resume
113 normal distribution of the Hispanic Achievers license plate. If,
114 after 24 months, the minimum of 1,000 sales has not been met,
115 the department shall discontinue the Hispanic Achievers license
116 plate. This subsection is repealed June 30, 2016.
117 (83) FALLEN LAW ENFORCEMENT OFFICERS LICENSE PLATES.—
118 (a) Notwithstanding s. 45, chapter 2008-176, Laws of
119 Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
120 and s. 320.08053(1), the department shall develop a Fallen Law
121 Enforcement Officers license plate as provided in s.
122 320.08053(2) and (3) and this section. The plate must bear the
123 colors and design approved by the department. The word “Florida”
124 must appear at the top of the plate, and the words “A Hero
125 Remembered Never Dies” must appear at the bottom of the plate.
126 (b) The annual use fees shall be distributed to the Police
127 and Kids Foundation, Inc., which may use a maximum of 10 percent
128 of the proceeds to promote and market the plate. The remainder
129 of the proceeds shall be used by the Police and Kids Foundation,
130 Inc., to invest and reinvest, and the interest earnings shall be
131 used for the operation of the Police and Kids Foundation, Inc.
132 (84) FLORIDA SHERIFFS ASSOCIATION LICENSE PLATES.—
133 (a) Notwithstanding s. 45, chapter 2008-176, Laws of
134 Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
135 and s. 320.08053(1), the department shall develop a Florida
136 Sheriffs Association license plate as provided in s.
137 320.08053(2) and (3) and this section. The plate must bear the
138 colors and design approved by the department. A sheriff’s star
139 must appear on the left side of the plate, the word “Florida”
140 must appear at the top of the plate, and the words “Florida
141 Sheriffs Association” must appear at the bottom of the plate.
142 (b) The annual use fees shall be distributed to the Florida
143 Sheriffs Association, a s. 501(c)(3) nonprofit organization,
144 which shall administer the fees as follows:
145 1. The Florida Sheriffs Association shall retain the first
146 $60,000 of the annual use fees as direct reimbursement for
147 administrative costs, startup costs, and cost incurred in the
148 development and approval process. Thereafter, up to 10 percent
149 of the annual use fee revenue may be used for administrative and
150 marketing costs.
151 2. All remaining collected revenue must be used for
152 continuing education for sheriff’s office members.
153 Section 3. Except as otherwise expressly provided in this
154 act, this act shall take effect October 1, 2014.
