Florida Senate - 2014 SB 300 By Senator Bullard 39-00344-14 2014300__ 1 A bill to be entitled 2 An act relating to postsecondary student tuition; 3 amending s. 1009.21, F.S.; providing an additional 4 category of nonresident persons exempt from paying 5 nonresident tuition at a state university or Florida 6 College System institution; providing an effective 7 date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Present paragraphs (a) through (k) of subsection 12 (10) of section 1009.21, Florida Statutes, are redesignated as 13 paragraphs (b) through (l), respectively, and a new paragraph 14 (a) is added to that subsection, to read: 15 1009.21 Determination of resident status for tuition 16 purposes.—Students shall be classified as residents or 17 nonresidents for the purpose of assessing tuition in 18 postsecondary educational programs offered by charter technical 19 career centers or career centers operated by school districts, 20 in Florida College System institutions, and in state 21 universities. 22 (10) The following persons shall be classified as residents 23 for tuition purposes: 24 (a) Beginning with the 2014 fall term, any person other 25 than a nonimmigrant alien within the meaning of 8 U.S.C. s. 26 1101(a)(15) who: 27 1. Attended a high school in this state for at least 3 28 consecutive or nonconsecutive school years; 29 2. Graduated from a high school in this state or attained a 30 high school equivalency diploma pursuant to s. 1003.435; 31 3. Registered as an entering student or is currently 32 enrolled at a state university or a Florida College System 33 institution; and 34 4. If he or she is without lawful immigration status, files 35 an affidavit with the state university or the Florida College 36 System institution at which he or she is registered or enrolled 37 stating that he or she has filed an application to legalize his 38 or her immigration status or will file an application as soon as 39 he or she is eligible to do so. 40 Section 2. This act shall take effect July 1, 2014.
