Subsection (5) is added to section 403.709, 6 Florida Statutes, to read: 7 403.709 Solid Waste Management Trust Fund; use of waste 8 tire fees.—There is created the Solid Waste Management Trust 9 Fund, to be administered by the department. 10 (5)(a) Notwithstanding subsection (1), a solid waste 11 landfill closure account is established within the Solid Waste 12 Management Trust Fund to provide funding for the closing and 13 long-term care of solid waste management facilities. The 14 department may use funds from the account to contract with a 15 third party for the closing and long-term care of a solid waste 16 management facility if: 17 1. The facility has or had a department permit to operate 18 the facility; 19 2. The permittee provided proof of financial assurance for 20 closure in the form of an insurance certificate; 21 3. The facility is deemed to be abandoned or was ordered to 22 close by the department; 23 4. Closure is accomplished in substantial accordance with a 24 closure plan approved by the department; and 25 5. The department has written documentation that the 26 insurance company issuing the closure insurance policy will 27 provide or reimburse the funds required to complete closing and 28 long-term care of the facility. 29 (b) The department shall deposit the funds received from 30 the insurance company as reimbursement for the costs of or long 31 term care of the facility into the solid waste landfill closure 32 account. 33 34 ================= T I T L E A M E N D M E N T ================ 35 And the title is amended as follows: 36 Delete lines 2 - 15 37 and insert: 38 An act relating to waste; amending s. 376.78, F.S.; 39 revising legislative intent with regard to community 40 revitalization in certain areas; amending s. 376.80, 41 F.S.; revising procedures for designation of 42 brownfield areas by local governments; providing 43 procedures for adoption of a resolution; providing 44 requirements for notice and public hearings; 45 authorizing local governments to use a term other than 46 “brownfield area” when naming such areas; amending s. 47 376.82, F.S.; providing an exemption from liability 48 for property damage for entities that execute and 49 implement certain brownfield site rehabilitation 50 agreements; providing for applicability; amending s. 51 403.709, F.S.; establishing a solid waste landfill 52 closure account within the Solid Waste Management 53 Trust Fund; authorizing the Department of 54 Environmental Protection to use funds to contract with 55 certain parties; requiring the department to deposit 56 certain funds into the solid waste landfill closure 57 account; providing an effective date.
