       Senator Latvala moved the following:
       
    1         Senate Amendment (with title amendment)

    3         Between lines 679 and 680
    4  insert:
    5         Section 11. Subsection (9) of section 718.117, Florida
    6  Statutes, is amended to read:
    7         718.117 Termination of condominium.—
    8         (9) PLAN OF TERMINATION.—The plan of termination must be a
    9  written document executed in the same manner as a deed by unit
   10  owners having the requisite percentage of voting interests to
   11  approve the plan and by the termination trustee. A copy of the
   12  proposed plan of termination shall be given to all unit owners,
   13  in the same manner as for notice of an annual meeting, at least
   14  14 days before prior to the meeting at which the plan of
   15  termination is to be voted upon or prior to or simultaneously
   16  with the distribution of the solicitation seeking execution of
   17  the plan of termination or written consent to or joinder in the
   18  plan. A unit owner may document assent to the plan by executing
   19  the plan or by consent to or joinder in the plan in the manner
   20  of a deed. A plan of termination and the consents or joinders of
   21  unit owners and, if required, consents or joinders of mortgagees
   22  must be recorded in the public records of each county in which
   23  any portion of the condominium is located. The plan is effective
   24  only upon recordation or at a later date specified in the plan.
   25  If the plan of termination fails to receive the required
   26  approval, the plan may not be recorded and a new attempt to
   27  terminate the condominium may not be proposed at a meeting or by
   28  solicitation for joinder and consent for 180 days after the date
   29  that such failed plan of termination was first given to all unit
   30  owners in the manner as provided in this subsection.
