1 A bill to be entitled
2 An act relating to the state employees’ prescription
3 drug program; reenacting and amending s. 110.12315(2),
4 F.S., relating to the state employees’ prescription
5 drug program; deleting a requirement that the
6 Department of Management Services base its decision as
7 to whether to implement a certain 90-day supply limit
8 on a determination that it would be in the best
9 financial interest of the state; revising the pharmacy
10 dispensing fee; authorizing a retail pharmacy to fill
11 a 90-day supply of certain drugs; repealing s. 54(1),
12 ch. 2013-41, Laws of Florida, providing for the
13 reversion of provisions relating to the state
14 employees’ prescription drug program; providing an
15 effective date.

17 Be It Enacted by the Legislature of the State of Florida:

19 Section 1. Subsection (2) of section 110.12315, Florida
20 Statutes, is reenacted and amended to read:
21 110.12315 Prescription drug program.—The state employees’
22 prescription drug program is established. This program shall be
23 administered by the Department of Management Services, according
24 to the terms and conditions of the plan as established by the
25 relevant provisions of the annual General Appropriations Act and
26 implementing legislation, subject to the following conditions:
27 (2) In providing for reimbursement of pharmacies for
28 prescription medicines dispensed to members of the state group
29 health insurance plan and their dependents under the state
30 employees’ prescription drug program:
31 (a) Retail pharmacies participating in the program must be
32 reimbursed at a uniform rate and subject to uniform conditions,
33 according to the terms and conditions of the plan.
34 (b) There is shall be a 30-day supply limit for
35 prescription card purchases and a 90-day supply limit for mail
36 order or mail order prescription drug purchases. The Department
37 of Management Services may implement a 90-day supply limit
38 program for certain maintenance drugs as determined by the
39 department at retail pharmacies participating in the program if
40 the department determines it to be in the best financial
41 interest of the state.
42 (c) The current pharmacy dispensing fee shall be the lesser
43 of:
44 1. $4.28 for each prescription filled at retail;
45 2. $4.22 for each prescription filled at mail order or by a
46 specialty pharmacy; or
47 3. The amount negotiated by the department for a 90-day
48 supply of a prescription of a drug on the mandatory maintenance
49 drug list which is filled at a retail pharmacy remains in
50 effect.
51 (d) A retail pharmacy may fill a 90-day supply of a
52 prescription of a drug on the mandatory maintenance drug list in
53 accordance with subparagraph (c)3.
54 Section 2. Subsection (1) of section 54 of chapter 2013-41,
55 Laws of Florida, is repealed.
56 Section 3. This act shall take effect July 1, 2014.
