1 A bill to be entitled
2 An act relating to the state employees’ prescription
3 drug program; reenacting and amending s. 110.12315(2),
4 F.S., relating to the state employees’ prescription
5 drug program; establishing a 90-day supply limit for
6 retail and mail order prescription drug purchases for
7 maintenance drugs; specifying that reimbursement for
8 retail and mail orders may not exceed a certain
9 amount; removing a provision authorizing the
10 Department of Management Services to implement a 90
11 day supply limit program under specified
12 circumstances; revising the pharmacy dispensing fee;
13 authorizing a retail pharmacy to fill a 90-day supply
14 of certain drugs; repealing s. 54(1), ch. 2013-41,
15 Laws of Florida, providing for the reversion of
16 provisions relating to the state employees’
17 prescription drug program; providing an effective
18 date.

20 Be It Enacted by the Legislature of the State of Florida:

22 Section 1. Subsection (2) of section 110.12315, Florida
23 Statutes, is reenacted and amended to read:
24 110.12315 Prescription drug program.—The state employees’
25 prescription drug program is established. This program shall be
26 administered by the Department of Management Services, according
27 to the terms and conditions of the plan as established by the
28 relevant provisions of the annual General Appropriations Act and
29 implementing legislation, subject to the following conditions:
30 (2) In providing for reimbursement of pharmacies for
31 prescription medicines dispensed to members of the state group
32 health insurance plan and their dependents under the state
33 employees’ prescription drug program:
34 (a) Retail pharmacies participating in the program must be
35 reimbursed at a uniform rate and subject to uniform conditions,
36 according to the terms and conditions of the plan.
37 (b) There is shall be a 30-day supply limit for
38 prescription card purchases and a 90-day supply limit for retail
39 and mail order or mail order prescription drug purchases for
40 maintenance drugs. Reimbursement for retail and mail order
41 purchases may not exceed the amount contracted by the department
42 for prescriptions fulfilled by mail order The Department of
43 Management Services may implement a 90-day supply limit program
44 for certain maintenance drugs as determined by the department at
45 retail pharmacies participating in the program if the department
46 determines it to be in the best financial interest of the state.
47 (c) The current pharmacy dispensing fee shall be the lesser
48 of:
49 1. $4.28 for each prescription filled at retail;
50 2. $4.22 for each prescription filled at mail order or by a
51 specialty pharmacy; or
52 3. The amount negotiated by the department for a 90-day
53 supply of a prescription of a drug on the mandatory maintenance
54 drug list which is filled at a retail pharmacy remains in
55 effect.
56 (d) A retail pharmacy may fill a 90-day supply of a
57 prescription of a drug on the mandatory maintenance drug list in
58 accordance with subparagraph (c)3.
59 Section 2. Subsection (1) of section 54 of chapter 2013-41,
60 Laws of Florida, is repealed.
61 Section 3. This act shall take effect July 1, 2014.
