    1                        A bill to be entitled                      
    2         An act relating to animal cruelty; amending s.
    3         828.073, F.S.; adding state attorneys to the list of
    4         entities authorized to file a petition in county court
    5         requiring the court to hold a hearing to determine
    6         whether an animal owner is able to care for the
    7         animal; amending s. 828.12, F.S.; requiring a
    8         mandatory minimum term of imprisonment for an act of
    9         aggravated animal cruelty; changing the minimum
   10         mandatory period of incarceration for a second or
   11         subsequent violation of animal cruelty from 6 months
   12         to 5 years; encouraging persons to report suspected
   13         animal cruelty; making it unlawful for an employer to
   14         prohibit an employee or volunteer from reporting
   15         suspected animal cruelty; amending s. 828.13, F.S.;
   16         providing that it is a crime to keep an animal in an
   17         enclosure without wholesome exercise or exchange of
   18         air; amending s. 921.0022, F.S.; revising the ranking
   19         of certain animal cruelty offenses in the offense
   20         severity ranking chart of the Criminal Punishment
   21         Code; providing an effective date.
   22          
   23  Be It Enacted by the Legislature of the State of Florida:
   24  
   25         Section 1. Subsections (2) and (3) and paragraph (a) of
   26  subsection (5) of section 828.073, Florida Statutes, are amended
   27  to read:
   28         828.073 Animals found in distress; when agent may take
   29  charge; hearing; disposition; sale.—
   30         (2) Any law enforcement officer or any agent of any county
   31  or of any society or association for the prevention of cruelty
   32  to animals appointed under the provisions of s. 828.03 may:
   33         (a) Lawfully take custody of any animal found neglected or
   34  cruelly treated by removing the animal from its present
   35  location, or
   36         (b) Order the owner of any animal found neglected or
   37  cruelly treated to provide certain care to the animal at the
   38  owner’s expense without removal of the animal from its present
   39  location,
   40  
   41  and shall file a petition seeking relief under this section in
   42  the county court of the county in which the animal is found
   43  within 10 days after the animal is seized or an order to provide
   44  care is issued. A state attorney may also file a petition
   45  seeking relief under this section in the county court of the
   46  county in which the animal is found within 10 days after the
   47  animal is seized or an order to provide care is issued. The
   48  court shall schedule and commence a hearing on the petition
   49  within 30 days after the petition is filed to determine whether
   50  the owner, if known, is able to provide adequately for the
   51  animal and is fit to have custody of the animal. The hearing
   52  shall be concluded and the court order entered thereon within 60
   53  days after the date the hearing is commenced. The timeframes set
   54  forth in this subsection are not jurisdictional. However, if a
   55  failure to meet such timeframes is attributable to the officer,
   56  state attorney, or agent, the owner is not required to pay the
   57  officer or agent for care of the animal during any period of
   58  delay caused by the officer or agent. A fee may not be charged
   59  for filing the petition. This subsection does not require court
   60  action for the taking into custody and making proper disposition
   61  of stray or abandoned animals as lawfully performed by animal
   62  control agents.
   63         (3) The officer, state attorney, or agent of any county or
   64  of any society or association for the prevention of cruelty to
   65  animals filing a petition taking charge of any animal pursuant
   66  to the provisions of this section shall have written notice
   67  served, at least 3 days before the hearing scheduled under
   68  subsection (2), upon the owner of the animal, if he or she is
   69  known and is residing in the county where the animal was taken,
   70  in conformance with the provisions of chapter 48 relating to
   71  service of process. The sheriff of the county shall not charge a
   72  fee for service of such notice.
   73         (5) In determining the person’s fitness to have custody of
   74  an animal under the provisions of this section act, the court
   75  may consider, among other matters:
   76         (a) Testimony from the agent or officer who seized the
   77  animal, a state attorney, and other witnesses as to the
   78  condition of the animal when seized and as to the conditions
   79  under which the animal was kept.
   80         Section 2. Subsections (1) and (2) of section 828.12,
   81  Florida Statutes, are amended, and subsection (6) is added to
   82  that section, to read:
   83         828.12 Cruelty to animals.—
   84         (1) A person who unnecessarily overloads, overdrives,
   85  torments, deprives of necessary sustenance or shelter, or
   86  unnecessarily mutilates, or kills any animal, or causes the same
   87  to be done, or carries in or upon any vehicle, or otherwise, any
   88  animal in a cruel or inhumane manner, commits animal cruelty, a
   89  misdemeanor of the first degree, punishable as provided in s.
   90  775.082 or s. 775.083 or by a fine of not more than $5,000, or
   91  both.
   92         (2) A person who intentionally commits an act to any
   93  animal, or a person who owns or has the custody or control of
   94  any animal and fails to act, which results in the cruel death,
   95  or excessive or repeated infliction of unnecessary pain or
   96  suffering, or causes the same to be done, commits aggravated
   97  animal cruelty, a felony of the third degree, and shall be
   98  sentenced to a mandatory minimum term of imprisonment of 30
   99  months and ordered to pay punishable as provided in s. 775.082
  100  or by a fine of not more than $5,000 $10,000, or both.
  101         (a) A person convicted of a violation of this subsection,
  102  where the finder of fact determines that the violation includes
  103  the knowing and intentional torture or torment of an animal that
  104  injures, mutilates, or kills the animal, shall be ordered to pay
  105  a minimum mandatory fine of $2,500 and undergo psychological
  106  counseling or complete an anger management treatment program.
  107         (b) A person convicted of a second or subsequent violation
  108  of this subsection shall be required to pay a minimum mandatory
  109  fine of $5,000 and serve a minimum mandatory period of
  110  incarceration of 5 years 6 months. In addition, the person shall
  111  be released only upon expiration of sentence, is not eligible
  112  for parole, control release, or any form of early release, and
  113  must serve 100 percent of the court-imposed sentence. Any plea
  114  of nolo contendere shall be considered a conviction for purposes
  115  of this subsection.
  116         (6) The Legislature encourages persons to report suspected
  117  animal cruelty to a law enforcement agency or to a county or
  118  municipal animal control agency. Employers may not prohibit an
  119  employee or volunteer from reporting suspected animal cruelty.
  120  An employer who violates this subsection commits a misdemeanor
  121  of the second degree, punishable as provided in s. 775.082 or s.
  122  775.083.
  123         Section 3. Subsection (2) of section 828.13, Florida
  124  Statutes, is amended to read:
  125         828.13 Confinement of animals without sufficient food,
  126  water, or exercise; abandonment of animals.—
  127         (2) Whoever:
  128         (a) Impounds or confines any animal in any place and fails
  129  to supply the animal during such confinement with a sufficient
  130  quantity of good and wholesome food and water,
  131         (b) Keeps any animals in any enclosure without wholesome
  132  exercise or and change of air, or
  133         (c) Abandons to die any animal that is maimed, sick,
  134  infirm, or diseased,
  135  
  136  commits is guilty of a misdemeanor of the first degree,
  137  punishable as provided in s. 775.082 or s. 775.083 or by a fine
  138  of not more than $5,000, or by both imprisonment and a fine.
  139         Section 4. Paragraphs (c) and (g) of subsection (3) of
  140  section 921.0022, Florida Statutes, are amended to read:
