    5         551.0221Elections for ratification of permits.—
    6         (1) After the department issues a permit to a permitholder,
    7  the permit is not effective until approved by a majority of
    8  electors voting in a countywide referendum in the county for
    9  which the permit was issued. The permitholder must present to
   10  the board of county commissioners, at a regular or special
   11  meeting of the board, a certified copy of the permit issued by
   12  the department and a written application requesting that the
   13  issue be placed on the ballot. After such presentation, the
   14  board of county commissioners shall place on the next general
   15  election ballot the question of whether the permit shall be
   16  approved and a license issued and race or game meetings allowed
   17  in the county by the permitholder. The board of county
   18  commissioners may not place such question on the next general
   19  election ballot if the permitholder’s presentation to the board
   20  of county commissioners occurs less than 90 days before the next
   21  general election. Each permit for a track or fronton must be
   22  voted upon separately and in separate elections.
   23         (2) The supervisor of elections shall canvass the votes
   24  cast on the question submitted to the electors and report the
   25  results to the board of county commissioners. The board of
   26  county commissioners shall immediately certify the results of
   27  the election to the department.
   28         (3) If the permitholder does not apply to the board of
   29  county commissioners within 6 months after the permit is issued,
   30  the permit is void. The department shall cancel the permit
   31  without notice to the permitholder, and the board of county
   32  commissioners holding the deposit for the election shall refund
   33  the deposit to the permitholder upon being notified by the
   34  department that the permit is void and has been canceled.
