       Senator Legg moved the following:
       
    1         Senate Amendment to Amendment (877970) (with title
    2  amendment)

    4         Before line 5
    5  insert:
    6         Section 1. Paragraph (f) of subsection (4) of section
    7  1001.42, Florida Statutes, is amended to read:
    8         1001.42 Powers and duties of district school board.—The
    9  district school board, acting as a board, shall exercise all
   10  powers and perform all duties listed below:
   11         (4) ESTABLISHMENT, ORGANIZATION, AND OPERATION OF SCHOOLS.
   12  Adopt and provide for the execution of plans for the
   13  establishment, organization, and operation of the schools of the
   14  district, including, but not limited to, the following:
   15         (f) Opening and closing of schools; fixing uniform date.
   16  Adopt policies for the opening and closing of schools and fix
   17  uniform dates; however, beginning with the 2007-2008 school
   18  year, the opening date for schools in the district may not be
   19  earlier than August 10 of 14 days before Labor Day each year.
   20         Section 2. Paragraph (k) of subsection (2) of section
   21  1003.621, Florida Statutes, is redesignated as paragraph (l),
   22  and a new paragraph (k) is added to that subsection to read:
   23         1003.621 Academically high-performing school districts.—It
   24  is the intent of the Legislature to recognize and reward school
   25  districts that demonstrate the ability to consistently maintain
   26  or improve their high-performing status. The purpose of this
   27  section is to provide high-performing school districts with
   28  flexibility in meeting the specific requirements in statute and
   29  rules of the State Board of Education.
   30         (2) COMPLIANCE WITH STATUTES AND RULES.—Each academically
   31  high-performing school district shall comply with all of the
   32  provisions in chapters 1000-1013, and rules of the State Board
   33  of Education which implement these provisions, pertaining to the
   34  following:
   35         (k) Section 1001.42(4)(f), relating to the uniform opening
   36  date of public schools.
