A woman who 6 states that she is a victim of rape, incest, domestic violence, 7 or human trafficking and is not able to present to the physician 8 a copy of a restraining order, police report, medical record, or 9 other court order or documentation evidencing her statement has 10 a right to waive the 24 hour mandatory waiting period. In the 11 event a woman has exercised her right to waive the state 12 mandated delay, the woman’s health care provider is not subject 13 to any criminal, civil, or administrative penalties for failure 14 to secure consent 24 hours in advance of the procedure. The 15 woman’s signature noting that she has exercised her right to 16 waive certain requirements is sufficient proof of provider 17 compliance.
