    1                        A bill to be entitled                      
    2         An act relating to used tire sales; prohibiting the
    3         sale of certain used passenger or light truck tires by
    4         a used tire retailer; designating what constitutes an
    5         unsafe used tire; providing that violations of the act
    6         are deceptive and unfair trade practices; providing an
    7         effective date.
    8          
    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Sale of unsafe used tires.—
   12         (1) A used tire retailer in this state may not sell unsafe
   13  used passenger or light truck tires for the purpose of mounting
   14  on a vehicle unless such tires are sold for recapping.
   15         (2) For purposes of this section, a used tire is considered
   16  unsafe if any of the following is determined:
   17         (a) Any area of the tread is worn to 2/32-inch tread depth
   18  or less.
   19         (b) Damage to the tire, including any cut, crack, bulge,
   20  puncture, scrape, or wear, exposes the reinforcing plies of the
   21  tire.
   22         (c) The tire has been improperly repaired in one or more of
   23  the following manners:
   24         1. A repair made in the tread shoulder or belt edge area of
   25  the tire.
   26         2. A puncture repair in which the tire has not been sealed
   27  or patched on the inside and repaired with a cured rubber stem
   28  through to the outside of the tire.
   29         3. A repair to the sidewall or bead area of the tire.
   30         4. A repair of a puncture larger than one-fourth of an
   31  inch.
   32         (d) The tire shows evidence of prior use of a temporary
   33  tire sealant without evidence of a subsequent proper repair.
   34         (e) The tire identification number has been defaced or
   35  removed.
   36         (f) The tire has inner liner or bead damage.
   37         (g) The tire shows evidence of internal separation, such as
   38  a bulge or local area of irregular tread wear.
   39         (3) A person who knowingly violates this section commits a
   40  deceptive and unfair trade practice actionable under the Florida
   41  Deceptive and Unfair Trade Practices Act pursuant to part II of
   42  chapter 501, Florida Statutes.
   43         Section 2. This act shall take effect July 1, 2015.
