    1                        A bill to be entitled                      
    2         An act relating to use of force; amending s. 776.013,
    3         F.S.; specifying that a person who is in his or her
    4         dwelling, residence, or vehicle does not have a duty
    5         to retreat, regardless of whether he or she is
    6         attacked, and has the right to stand his or her
    7         ground; reenacting s. 776.032(1), F.S., to incorporate
    8         the amendment made to s. 776.013, F.S., in a reference
    9         thereto; providing an effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Subsection (3) of section 776.013, Florida
   14  Statutes, is amended to read:
   15         776.013 Home protection; use or threatened use of deadly
   16  force; presumption of fear of death or great bodily harm.—
   17         (3) A person who is attacked in his or her dwelling,
   18  residence, or vehicle has no duty to retreat and has the right
   19  to stand his or her ground and use or threaten to use force,
   20  including deadly force, if he or she uses or threatens to use
   21  force in accordance with s. 776.012(1) or (2) or s. 776.031(1)
   22  or (2).
   23         Section 2. Subsection (1) of s. 776.032, Florida Statutes,
   24  is reenacted for the purpose of incorporating the amendment made
   25  by this act to s. 776.013, Florida Statues, in a reference
   26  thereto.
   27         Section 3. This act shall take effect July 1, 2015.
