Florida Senate - 2016 SB 690 By Senator Evers 2-00772-16 2016690__ 1 A bill to be entitled 2 An act relating to specialty license plates; amending 3 s. 320.08056, F.S.; providing annual use fees for the 4 Support Special Needs Kids and the America the 5 Beautiful specialty license plates; amending s. 6 320.08058, F.S., revising the distribution 7 requirements for annual use fees for the In God We 8 Trust specialty license plate; directing the 9 Department of Highway Safety and Motor Vehicles to 10 develop the Support Special Needs Kids and the America 11 the Beautiful specialty license plates; providing for 12 the distribution of annual use fees received from the 13 sale of such plates; providing an effective date. 14 15 Be It Enacted by the Legislature of the State of Florida: 16 17 Section 1. Paragraphs (ffff) and (gggg) are added to 18 subsection (4) of section 320.08056, Florida Statutes, to read: 19 320.08056 Specialty license plates.— 20 (4) The following license plate annual use fees shall be 21 collected for the appropriate specialty license plates: 22 (ffff) Support Special Needs Kids license plate, $25. 23 (gggg) America the Beautiful license plate, $25. 24 Section 2. Subsection (66) of section 320.08058, Florida 25 Statutes, is amended, and subsections (84) and (85) are added to 26 that section, to read: 27 320.08058 Specialty license plates.— 28 (66) IN GOD WE TRUST LICENSE PLATES.— 29 (a) The department shall develop an In God We Trust license 30 plate as provided in this section. However, the requirements of 31 s. 320.08053 must be met before the plates are issued. In God We 32 Trust license plates must bear the colors and design approved by 33 the department. The word “Florida” must appear at the top of the 34 plate, and the words “In God We Trust” must appear in the body 35 of the plate. 36(b) The license plate annual use fees shall be distributed37to the In God We Trust Foundation, Inc., to fund educational38scholarships for the children of Florida residents who are39members of the United States Armed Forces, the National Guard,40and the United States Armed Forces Reserve and for the children41of public safety employees who have died in the line of duty who42are not covered by existing state law. Funds shall also be43distributed to other s. 501(c)(3) organizations that may apply44for grants and scholarships and to provide educational grants to45public and private schools to promote the historical and46religious significance of American and Florida history. The In47God We Trust Foundation, Inc., shall distribute the license48plate annual use fees in the following manner:491. The In God We Trust Foundation, Inc., shall retain all50revenues from the sale of such plates until all startup costs51for developing and establishing the plate have been recovered.522. Ten percent of the funds received by the In God We Trust53Foundation, Inc., shall be expended for administrative costs,54promotion, and marketing of the license plate directly55associated with the operations of the In God We Trust56Foundation, Inc.573. All remaining funds shall be expended by the In God We58Trust Foundation, Inc., for programs.59 (b) The annual use fees from the plate shall be distributed 60 as a charitable donation to the In God We Trust Foundation, 61 Inc., which may use a maximum of 10 percent of the proceeds to 62 offset marketing, administration, and promotion, and which may 63 use the balance of the fees to address the needs of military 64 service members and their spouses and dependents; provide 65 education in public and private schools regarding the historical 66 significance of religion in American and Florida history; 67 provide educational grants in public and private schools; 68 address the needs of public safety employees and their spouses 69 and dependents; and foster self-reliance and stability in 70 Florida’s children and families. 71 (84) SUPPORT SPECIAL NEEDS KIDS LICENSE PLATES.— 72 (a) Notwithstanding s. 45, chapter 2008-176, Laws of 73 Florida, as amended by s. 21, chapter 2010-223, Laws of Florida, 74 and s. 45, chapter 2014-216, Laws of Florida, the department 75 shall develop a Support Special Needs Kids license plate as 76 provided in this section and s. 320.08053. The word “Florida” 77 must appear at the top of the plate, and the words “Support 78 Special Needs Kids” must appear at the bottom of the plate. 79 (b) The department shall retain all annual use fees from 80 the sale of the plate until startup costs for developing and 81 issuing the plates have been recovered. Thereafter, the annual 82 use fees from the sale of the plate shall be distributed to the 83 Dan Marino Foundation, Inc., which: 84 1. May use a maximum of 10 percent of the proceeds to 85 promote and market the Support Special Needs Kids license plate. 86 2. Shall invest and reinvest the remainder of the proceeds 87 and use the interest thereon to assist Floridians with 88 developmental and intellectual disabilities by funding 89 scholarships, assisting with job placement, and promoting 90 education, independence, and awareness. 91 (85) AMERICA THE BEAUTIFUL LICENSE PLATES.— 92 (a) Notwithstanding s. 45, chapter 2008-176, Laws of 93 Florida, as amended by s. 21, chapter 2010-223, Laws of Florida, 94 and s. 45, chapter 2014-216, Laws of Florida, the department 95 shall develop an America the Beautiful license plate as provided 96 in this section and s. 320.08053. The word “Florida” must appear 97 at the top of the plate, and the words “America the Beautiful” 98 must appear at the bottom of the plate. 99 (b) The America the Beautiful Fund shall retain annual use 100 fees from the sale of the plate until startup costs for 101 developing and issuing the plate have been recovered. 102 Thereafter, the annual use fees from the sale of the plate shall 103 be distributed to the America the Beautiful Fund, which may use 104 a maximum of 10 percent of the proceeds to offset administrative 105 costs of the organization and to market and promote the plate, 106 and the remainder of the proceeds for programs in support of 107 military service members and their families and advancing self 108 sufficiency in children and families; educational scholarships; 109 and land and wildlife conservation to ensure sustained and 110 equitable benefit to people, animals, and wildlife. 111 Section 3. This act shall take effect October 1, 2016.
